No. 26481 Service Date: August 29, 2019 DEPARTMENT OF PUBLIC SERVICE REGULATION BEFORE THE PUBLIC SERVICE COMMISSION OF THE STATE OF MONTANA IN THE MATTER OF Cut Bank Gas Company's Petition for Accounting Order Authorizing the Deferral of Incremental 2019 Property Tax Expenses Resulting from a Change in the Taxing Methodology used by the Montana Department of Revenue REGULATORY DIVISION DOCKET NO. 2019.08.048 NOTICE OF PETITION AND INTERVENTION DEADLINE On August 7, 2019, Cut Bank Gas Company ("CBGC"), filed a Petition for an Accounting Order authorizing the deferral of incremental 2019 property tax expenses ("Petition") with the Montana Public Service Commission ("Commission"). The Petition requests an accounting order to permit CBGC to recover, in a future proceeding, its actual costs resulting from an increase in 2019 property tax expense. The increased property tax, CBGC alleges, is the result of a decision, by the Montana Department of Revenue ("DOR"), to begin assessing CBGC's property centrally, rather than locally. CBGC alleges that this results in a significant increase in its property tax expense from $22,890 in 2018 to an anticipated $64,873 in 2019 (resulting in an increase of $41,983 over 2018 property tax expenses). CBGC also contends that rates established in its most recent rate case provided for recovery of only $18,006 annually, based on property tax expenses from a 2016 test year. A copy of CBGC's Petition is available for inspection at the Commission's business offices, 1701 Prospect Avenue, P.O. Box 202601, Helena, Montana 59620-2601; and the Montana Consumer Counsel ("MCC"), 111 North Last Chance Gulch, Suite 1B, P.O. Box 201703, Helena, Montana 59620-1703, telephone (406) 444-2771. The MCC is available to represent the interests of the consuming public in this matter. The Commission invites parties directly affected by CBGC's Petition to intervene. To intervene, parties must file a Petition to Intervene with the Commission no later than September 20, 2019. By the intervention deadline, petitioners must submit: (1) an electronic petition to the Commission website at http://psc.mt.gov ("EDDI, Customer Portal & E-Filing" icon); (2) physically deliver or mail the original petition to the Commission at the address above; (3) a hard copy to the MCC at the address above, and to CBGC's Counsel, Nikolas S. Stoffel and D. Austin Rueschhoff, Holland & Hart LLP, 6380 South Fiddlers Green Circle, Suite 500, Greenwood Village, Colorado 80111. The Commission will not post an e-filed document to its website until it receives the original from the petitioner. The Commission also invites parties who do not wish to formally intervene to submit written public comments on the matter to the Commission address stated above, or through its web-based comment form at http://psc.mt.gov ("Comment on a Proceeding" under the "Documents & Proceedings" tab).
