CAHALAN, as successor Trustee of the public sale of the real property hereinafter described pursuant to the "Small Tract Financing Act of Montana" (Section 71-1-301, et seq., MCA). CAHALAN, an attorney licensed to practice law in the State of Montana, by Substitution of Trustee dated August 21, 2017 and recorded August 22, 2017 as document #201700020419 records of the Clerk and Recorder of Flathead County, Montana (the "Trustee") Present Beneficiary: Stephen K. Nelson, an individual (the "Beneficiary") Present Owner of Record, Mauifish, LLC of property covered by the Trust Indenture: DESCRIPTION OF THE PROPERTY COVERED BY THE TRUST INDENTURE (the "Premises"): Tract 2 of Certificate of Survey No. 5536, a Tract of Land in the West Half of the Northwest Quarter of the Northeast Quarter of Section 28, Township 31 North, Range 21 West, P.M.M., Flathead County, Montana. (Commonly known as 480 & 488 Keading Creek Rd., Whitefish, MT) RECORDING DATA FOR TRUST INDENTURE: The instrument under which this sale is to be conducted is that certain Montana Trust Indenture dated December 2, 2016, which was recorded December 2, 2016, as Document # 201600026892 in the records of Flathead County, Montana, and which Trust Indenture covers real property situated in Flathead County, Montana, (the "Trust Indenture"). DEFAULT FOR WHICH FORECLOSURE IS MADE: The multiple defaults for which this foreclosure is made consists of: 1) a failure by the Grantor or any person to pay the monthly payments of Six Thousand One Hundred Fifty and 67/100 Dollars ($6,150.67) due on the 2nd day of each month from September 2, 2018 and October 2, 2018 on the promissory note, for which the Trust Indenture was given as security; , 2) a failure by the Grantor to pay the 2017 property taxes on the Premises causing the taxes to become delinquent; and 3) a failure by the Grantor to maintain property/casualty insurance on the improvements placed on the Premises. SUM OWING ON OBLIGATION SECURED BY THE TRUST INDENTURE: There is presently due on the obligation secured by the Trust Indenture the principal sum of SIX HUNDRED SEVENTY THOUSAND AND NO/100 DOLLARS ($670,000.00), together with interest thereon, which as of October 30, 2018 totaled NINETEEN THOUSAND SEVEN HUNDRED EIGHTY SEVEN AND 93/100 DOLLARS ($19,787.93), plus Late Charges of FOUR HUNDRED AND NO/100 DOLLARS ($400.00) and Escrow Fees of NINETY-THREE AND NO/100 DOLLARS ($93.00). Interest continues to accrue at the daily rate of $202.1643. In addition, the Beneficiary intends to disburse such amounts as may be required to preserve and protect the Premises, including property/casualty insurance, and for real property taxes and assessments that may become due or delinquent, unless such amounts or taxes are paid by the Grantor or the Grantor's successor(s) in interest. If such amounts are paid by the Beneficiary, the amounts, taxes or assessments and interest will be added to the obligation secured by the Trust Indenture. Other expenses to be charged against the proceeds of the sale include the trustee's and attorney's fees, costs and expenses of sale and late charges, if any. ELECTION TO SELL: The Beneficiary has elected and directed in writing the Trustee to sell the Premises above described at public sale to the highest qualified bidder to satisfy the aforesaid obligations. DATE AND TIME OF SALE: The sale will be held on February 28, 2019 at the hour of 11:00 o'clock a.m. PLACE OF SALE: The sale will be held on the front steps of the Flathead County Justice Center, 920 South Main Street, Kalispell, MT 59901, City of Kalispell. TERMS OF SALE: This sale is a public sale and any person including the Beneficiary (excepting only the undersigned Trustee) may bid at the sale. No. 26558 NOTICE OF PUBLIC HEARING A proposal to enact a Stormwater Management Program Ordinance, as required by Federal and State law, will be presented at a Public Hearing, Monday, October 21, 2019, in the Council Chambers of City Hall, 201 1st Avenue East, Kalispell, Montana, at 7:00 P.M.
