Teen's trial to resume July 7

The preliminary trial for a girl charged with the deaths of two people on U.S. 93 last year resumes July 7.

Justine Winter, 17, is charged with two counts of deliberate homicide in the deaths of Erin Johnson, 35, and her 13-year-old son Caden Odell.

The results of the preliminary trial will determine whether Winter is tried as a juvenile or an adult.

District Judge Katherine Curtis heard Thursday morning from Winter’s father, Randy, who discussed the injuries his daughter suffered in the March 19, 2009, crash.

Flathead County Attorney Ed Corrigan asked Winter whether his daughter is capable of driving a car.

Winter said he didn’t know; ankle injuries Justine suffered in the crash might hinder her ability to drive.

Winter also said that his daughter now is afraid of driving — and even of riding in a car.

She is prevented by a court order from operating a motor vehicle.

Justine Winter waived her right to attend court Thursday and was not present during her father’s testimony.

Winter’s attorneys will call two witnesses when the trial resumes 1:30 p.m. July 7.
