No. 27206 NOTICE OF TRUSTEE'S SALE Notice of the sale of real property that is secured by a Montana Trust Indenture is hereby given by Ryan D. Purdy, of the law firm of Frampton Purdy Law Firm, Trustee, pursuant to the provisions of the Small Tract Financing Act of Montana (§71-1-301, et. seq., M.C.A.). TO BE SOLD FOR CASH AT TRUSTEE'S SALE on the 17th day of November, 2020, at 10:15 a.m. in the office of Frampton Purdy Law Firm as 530 West 19th Street, Suite 301, Whitefish, MT 59937, the following described real property situated in Flathead County, Montana: Lot 17 of Cheery Lynn Estates, according to the map or plat thereof on file and of record in the office of the Clerk and Recorder of Flathead County, Montana. AMOUNT DUE: As of the 30th day of June, 2020, the amount due on the Loan, as amended/modified from time to time, is $27,654.33, inclusive of i) principal in the amount of $26,615.37, ii) interest totaling $732.56, iii) late payment penalties totaling $306.40, and iv) other fees and expenses advanced of $1,587.30, plus accruing interest at $3.0991 per diem together with late charges, and others costs and fees that may be advanced through the date of sale. The Beneficiary anticipates and may disburse such additional amounts as may be required to preserve and protect the Property and its security interest therein and prosecute its rights and remedies. If such amounts are paid by the Beneficiary, the amounts will be added to the obligations secured by the Trust Indenture. ELECTION TO SELL: Beneficiary has elected and has directed the Successor Trustee to sell the above described Property to satisfy the Grantor's obligations. TERMS OF SALE: The sale is a public sale and any person, including the Beneficiary, excepting only the Trustee, may bid at the sale. The bid price must be paid in cash at the time of sale, excepting that Beneficiary may bid via credit bid up to the total amount owed on the Loan. The conveyance will be made by Trustee's Deed. The sale purchaser shall be entitled to possession of the Property on the 10th day following the sale. RIGHT TO CURE: The Grantor(s), successor in interest to the Grantor(s), or any other person having an interest in the Property, at any time prior to the Trustee's sale, may have the right to cure the default by paying to the Beneficiary or the successor in interest to the Beneficiary the entire amount then due to the Beneficiary, including costs, expenses, and attorney's fees, other than such portion of the principal as would not then be due to the Beneficiary had no defaults occurred. In the event that the defaults are cured as stated above, the Trustee's Sale will be cancelled, as provided by §71-1-312, MCA. No. 27219 Montana Fish, Wildlife & Parks (FWP) proposes to purchase approximately 106 acres of land along the north shore of Flathead Lake to the east of the community of Somers for the creation of a new State Park. While the exact cost of the property will not be determined until after a final appraisal (to be done in September 2020), the preliminary appraisal was $2,840,000. Funding for the project would be provided by a grant from the Land and Water Conservation Fund (pending) with matches from Parks Earned Revenue or General License Fund. The primary purpose of the proposed land acquisition is to create a new state park for inclusion in the Montana State Park system for the use and enjoyment of the people of Montana and its visitors. The current owners of the property have allowed public access on the site for decades and FWP wants to ensure that access in perpetuity. The public comment period for this draft EA will extend for 30 days beginning August 14, 2020.
