No. 27508 Service Date: January 21, 2021 DEPARTMENT OF PUBLIC SERVICE REGULATION BEFORE THE PUBLIC SERVICE COMMISSION OF THE STATE OF MONTANA IN THE MATTER OF the Public Service Commission's Request for Comments Regarding Implementation of HB 597 REGULATORY DIVISION DOCKET NO. 2021.01.007 NOTICE OF OPPORTUNITY TO COMMENT The 2019 Montana Legislature enacted House Bill 597 ("HB 597") which, among other things, implemented changes to the utility long-term planning process and added requirements for competitive solicitations for electric resources. These changes are codified in Montana Code Ann. §§ 69-3-1201 through 69-3-1209 and 69-8-421, and became effective July 1, 2020. The Commission requests comments from interested persons regarding changes that should be made to existing Commission administrative rules to implement the provisions of HB 597, excluding the hearings examiner provisions. To facilitate the consideration of necessary or appropriate changes, the Commission has developed a preliminary rules proposal. The Commission's preliminary rules proposal would repeal altogether the existing rules in Mont. Admin. R. 38.5.2001, et seq. The Commission's preliminary proposal uses the planning rules in Mont. Admin. R. 38.5.8201, et seq. as a starting point for implementing HB 597. However, much of the language in those rules would be repealed and replaced in an effort both to modernize the rules to apply to all utilities and incorporate new requirements from HB 597. PLEASE TAKE NOTICE that the Commission requests public comment on the draft rules by March 5, 2021.
