No. 29059 NOTICE FOR PUBLIC COMMENT REQUEST FOR FLOODPLAIN DEVELOPMENT PERMIT The City of Kalispell Floodplain Administrator has received the following Floodplain Development Permit application: A request was submitted by TD&H Engineering on behalf of Jag Capital Investments, LLC for a floodplain development permit to do work within the 100-year floodplain in the southwest portion of the Autumn Creek Subdivision. The proposed project will have impacts to wetlands on the property and involves the City requirement to upgrade and widen Hathaway Lane to City standards.  Required upgrades include but are not limited to street width, lighting, signage, curb & gutter, boulevard, and sidewalks.  Any temporary disturbances outside of the permanent improvements shall be mitigated and restored to existing natural conditions upon completion of construction. Additionally, the contractor will be responsible for the installation of BMPs during construction to aid in the protection of the surrounding wetlands and ensure sediment and erosion control is maintained across the site.  Approximately 170 linear feet of existing bank will be impacted.  The impacts will extend approximately 18 feet into the existing wetland and the widest portion of the proposed improvements. No. 29068 Legal Notice Partial Bond Release and Comprehensive Five-Year Bond Review for Tom Gauger (Hard Rock Mining Operating Permit No. 00171) The Department of Environmental Quality (DEQ) has received a request for bond release from Tom Gauger (Gauger). Gauger is authorized to operate a decorative rock quarry under Operating Permit No. 00171. The site is on private land in Sections 28, 32 and 33 in Township 2 South, Range 25 East, approximately 7 miles southeast of Laurel in Yellowstone County. DEQ currently holds a reclamation bond in the amount of $58,648. DEQ is proposing to release $28,700 and retain $29,948 after both releasing bond for completed reclamation tasks and increasing the bond from a comprehensive bond review. The bond release was requested by Gauger for reclamation work done including backfilling the quarry, recontouring disturbed area, and spreading at least 6 inches of soil on the site. DEQ has determined the partial completion of reclamation would decrease the currently required bond by $29,899 resulting in a required bond of $28,749. In addition to the request for bond release, DEQ is conducting a comprehensive bond review for Operating Permit No. 00171. DEQ has determined that the current bonding level does not represent the present costs of compliance with the Metal Mine Reclamation Act, administrative rules adopted thereunder, and the operating permit. DEQ is proposing to increase the bond by $1,199. The bond increase is largely due to changes in fuel price, equipment rates, removal of nonmobile site equipment and updated indirect costs such as mobilization, contingency, and administration. DEQ has determined the net effect on the bond from the release request ($29,899) and increase from the five‐year comprehensive review ($1,199) is a bond release of $28,700. The procedure for adjusting bonds from a comprehensive bond review is set forth in Section 82-4-338(3), MCA. Pursuant to Section 82-4-338(5), Montana Code Annotated (MCA), DEQ may not release or decrease a reclamation bond until the public has been provided an opportunity for a hearing and a hearing has been held if requested. The company and the public will have until Wednesday, January 4th, 2023, to comment on these proposed changes to the bond amount. DEQ will issue a final bond determination after the comment period has expired. The company, or any person with an interest that may be adversely affected by DEQ’s final bond determination, may obtain a contested case hearing before the Board of Environmental Review. A written request for a hearing must be filed with DEQ within 30 days of the issuance of the final bond determination, stating the reason for the request.
