No. 29453 NOTICE OF TRUSTEE’S SALE  Pursuant to the Small Tract Financing Act of Montana, Section 71-1-301, et seq., Montana Code Annotated, to be sold for cash at a Trustee’s Sale on July 17, 2023 at 11:00 A.M. Mountain Standard Time at the East door of the Flathead County Justice Center located at 920 South Main, Kalispell, Montana, the following described real property situated in Flathead County, State of Montana:  Improvement No. 178 located on State Leased Land, described as the Southeast Quarter of the Southwest Quarter of Section 23, Township 27 North, Range 19 West, P.M.M., Flathead County, Montana.  Jonathan Grant Carey of 2430 Hwy 83 Bigfork, MT 59911, as Grantor, conveyed said real property to Fidelity National Title of 1807 3rd Ave. E, Kalispell, MT 59901, as Trustee, to secure an obligation owed to Robert D. Stone and Cheryl L. Stone, Beneficiary of the security interest, by the Montana Trust Indenture recorded on the 5th day of October, 2020, as Document No. 202000033300 in the records of the Clerk and Recorder in Flathead County, Montana.  By instrument recorded on the 6th day of March, 2023, as Doc. No. 202300003287, records of Flathead County, Montana, Megan Timm, an attorney authorized to practice law in the state of Montana, was substituted as Trustee.  The Beneficiary has declared a default in the terms of the Montana Trust Indenture and the promissory note secured by the Montana Trust Indenture because of the Grantor’s failure to timely pay monthly installments of principal and interest beginning with the installment due on August 1, 2022 and on the first day of each month thereafter.  The amount due on said obligation secured by said Montana Trust Indenture is $109,820.61 as of March 7, 2023. The conveyance will be made by Trustee’s Deed, without any representation or warranty, including warranty of title, express or implied, as the sale is made strictly on an as-is, where-is basis, without limitation, the sale is being made subject to all existing conditions, if any, of lead paint, mold or other environmental or health hazards.
