How are protests submitted? Protests must be postmarked to the Department of Revenue, Office of Dispute Resolution, P.O. Box 5805, Helena, Montana 59604-5805 on or before December 13, 2024. What happens if the transfer is protested? Depending on the number of protests and the protest grounds, a public hearing will be held in Helena or Bigfork. All valid protestors will be notified of the hearing’s time, date and location. Hearings typically are scheduled within 90 days. A protester’s hearing testimony is limited to the grounds in the protester’s letter. On August 28, 2024, AP Countryside, LLC (“APC”) filed with the Montana Public Service Commission (“Commission”) an application seeking approval of the transfer of ownership and sale of the water and sewer facilities (“facilities”) serving the Creston Countryside Estate Phase II Subdivision near Kalispell, Montana that are currently owned by Creston Countryside Estates Phase II, LLC and/or Robert A. Fink (collectively, “the Seller”). APC subsequently amended its application on October 8, 2024 (“Application”). 2. In the Application, APC requests approval of the transfer of ownership and sale of the facilities, including water rights, from the Seller to APC. APC also requests approval to establish a $50 monthly flat rate for water services. APC additionally requests approval to establish the following ancillary charges: * Payment refused as a result of insufficient funding - $25.00 * Reconnection charge - $50.00. 3.
