NO. 31297 KALISPELL SCHOOL DISTRICT NO. 5 FLATHEAD HIGH SCHOOL DISTRICT FLATHEAD COUNTY, MONTANA RESOLUTION TO DISPOSE OF PERSONAL PROPERTY WHEREAS, the trustees of any school district have the power and responsibility to hold in trust all real and personal property of the district for the benefit of the schools and children of the district, and WHEREAS, Section 20-6-604, Montana Code Annotated (MCA), provides that whenever the trustees of a district determine that a site, building, or any other real or personal property of the district is or is about to become abandoned, obsolete, undesirable, or unsuitable for the school purposes of the district, the trustees may sell or otherwise dispose of the real or personal property, and WHEREAS, the district owns certain items of personal property, as listed on the Kalispell Public Schools website, which may include but are not limited to books, vehicles, and audio-visual equipment, and WHEREAS, the Board of Trustees of Kalispell School District No. 5 and Flathead High School District have determined that the items listed are obsolete, undesirable, or unsuitable for school purposes, NOW, THEREFORE, BE IT RESOLVED, that the Board of Trustees of Kalispell School District No. 5 and Flathead High School District shall sell or otherwise dispose of the property because it is obsolete, undesirable, or unsuitable for school purposes, and BE IT FURTHER RESOLVED, in accordance with 20-6-604, MCA, this resolution shall be published in a newspaper of general circulation and posted in three public places in the district. The resolution and a detailed list of the surplus items will also be posted on the district’s website. This resolution shall not become effective for 14 days. Upon expiration of the 14-day period, the Superintendent of the District shall effectuate the sale or disposal of the above-described property. Adopted this 27th day of May, 2025.
