Man guilty in drugs and gun case

Donald L. Guy, 39, of Kalispell, admitted Wednesday that he brandished a gun during a drug deal and was a felon in possession of a firearm.

Guy appeared before Chief U.S. District Judge Donald W. Molloy in Missoula. Sentencing is April 8.

An undercover agent from the Montana Department of Justice, Division of Criminal Investigation purchased methamphetamine from Guy on March 27, 2003. During the transaction, Guy retrieved a shotgun and placed it on the counter next to him.

When the deal was finished, he put the shotgun over his shoulder and accompanied the agent outside. It was clear to the agent that Guy showed the weapon for the purpose of intimidation.

On April 1, Guy was arrested and searched. he had a 9 mm handgun.

Guy was previously convicted in 1998 of possessing a controlled substance with intent to sell in California.

He must serve at least seven years in prison without parole, in addition to any other sentence, and spend five years on supervised release for brandishing a firearm during a drug trafficking crime.

For being a felon in possession, Guy faces possible penalties of 10 years in prison, a $250,000 fine and three years supervised release.

Assistant U.S. Attorney Josh Van de Wetering prosecuted the case for the United States.

The investigation was a cooperative effort between the Montana Department of Criminal Investigations and Alcohol, Tobacco, Firearms and Explosives.
