Rape suspect released after 3 months

A 20-year-old Whitefish woman charged with the rape of a 15-year-old baby sitter was released from jail following a hearing Thursday in Flathead District Court.

Nadine Hubble and her husband, Kory Hubble, 23, were charged after the teenage girl reported they provided her with marijuana and alcohol before raping her at their home on Nov. 17, 2011, after they hired her to baby-sit.

Kory Hubble bonded out of jail shortly after his arrest while Nadine Hubble remained in jail.

She has spent almost three months in jail.

It was noted with some confusion by District Judge Stewart Stadler that the property used to bail out Kory Hubble had sufficient value to also pay bond for his wife.

Nadine Hubble’s attorney, Sean Hinchey, said he approached Kory Hubble’s attorney about the possibility of her bond also being paid, but said that discussion didn’t go anywhere.

When asked by Stadler why that was the case, Hinchey replied, “Because apparently chivalry is dead.”

Nadine Hubble’s 8-month-old son is currently in the custody of her husband’s mother, with whom Kory Hubble is living.

“My son is the most important thing,” Nadine Hubble said of her reason for wanting to be released.

Stadler determined that it was in the best interests of the child that Nadine Hubble be released and that she posed no flight risk or threat to the community. The judge eliminated her bond, which had been set at $50,000.

She was ordered to have no contact with her husband. She will live with his grandmother.

Action on her case has been continued pending the return of crime lab results.

If convicted, the Hubbles each face between four years and life in prison and a fine of up to $50,000.
