Man pleads innocent to 5th DUI

A 47-year-old Coram man pleaded not guilty to his fifth offense of driving under the influence Feb. 23 during Flathead District Court.

According to court documents, Brian Colby pulled out directly in front of a deputy with the Flathead County Sheriff’s Office on U.S. 2 at midnight on Feb. 4. The deputy had to turn on his spotlight and sirens along with his emergency lights before Colby stopped.

When the deputy asked Colby to perform field sobriety tests, he allegedly told the officer “how about if I just say I’m drunk.” Colby then failed an Intoxilyzer test.

Colby has four prior convictions for DUI that came in March 1998, March 2000, September 2008 and February 2010.

If convicted, Colby faces between 13 months and five years in jail and a fine of between $1,000 and $10,000.

Colby’s next hearing is scheduled for June 13. He is being held in the Flathead County Detention Center on a $15,000 bond.
