Red-handed suspect pleads not guilty
A man allegedly caught literally red-handed has denied trying to burglarize a medical marijuana dispensary.
Nicholas Roark, 22, of Kila pleaded not guilty April 4 in Flathead District Court to a felony charge of attempted burglary in connection with the March 16 incident.
According to a court document, Flathead County deputies responded to a burglary report at Rocky Mountain Cannabis on Montana 35. There, they allegedly found Roark in a vehicle behind the business.
The court document alleges Roark had fresh blood on his hands, and that further investigation showed someone had cut and pried back a screen with a screwdriver at the business before trying to pry open a security door, on which deputies also found fresh blood.
Deputies allegedly found a Leatherman-type tool in Roark’s pocket with the screwdriver attachment extended.
If convicted, Roark faces up to 20 years in prison and a fine of up to $50,000. His next hearing is set for July 17.
Roark is currently released on his own recognizance.
