West Glacier man denies fourth DUI
A West Glacier man has pleaded not guilty to what would be his fourth offense of driving under the influence.
John Derby, 41, allegedly was found passed out at the wheel of his vehicle, with the engine still running and an open beer can in the vehicle’s cup holder, on Blankenship Bridge in the early morning hours of June 12.
A deputy reported Derby was sluggish, incoherent, had difficulty following instructions and slurred his speech. Derby allegedly failed a field sobriety test before refusing to take a breath alcohol test.
Derby’s prior convictions for drunk driving came in February 1997, March 2007 and August 2008.
If convicted, Derby faces up to five years in prison and a fine of between $1,000 and $10,000. His next hearing is set for Oct. 16.
