Suspect pleads innocent in man's death

A 54-year-old man has denied causing the death of another man at his Evergreen apartment earlier this month.

David Day pleaded not guilty to felony negligent homicide Thursday in Flathead District Court.

Day is alleged to have struck Gerald Payne, 55, in the face during an argument just outside the apartment on June 1, causing Payne to fall down a flight of stairs.

Payne later died from the injuries he sustained in the fall.

According to a court document, Day and Payne had spent the day drinking prior to the argument, and both became extremely drunk.

 If convicted, Day faces up to 20 years in prison and a fine of up to $50,000.

He is currently incarcerated in the Flathead County Detention Center, where his bond is set at $25,000. His next hearing is set for July 17.
