Man challenges sixth DUI charge
A 58-year-old Kalispell man pleaded not guilty Thursday in Flathead District Court to what would be his sixth offense of drunk driving.
Marvin Pomeroy was stopped by a Montana Highway Patrol trooper on Feb. 10, when he was allegedly traveling more than 10 miles per hour over the speed limit.
According to a court document, the trooper said Pomeroy slurred his speech and had watery eyes. Pomeroy allegedly admitted he had been drinking.
The court document states Pomeroy failed field sobriety tests and two breath alcohol tests.
His prior convictions for drunk driving came in July 1987, July 1991, July 1992, October 1993 and November 1994.
If convicted, Pomeroy faces up to five years in jail and a fine of between $1,000 and $10,000. His next hearing is set for March 6.
