C.F. man pleads not guilty to fourth DUI

A 37-year-old Columbia Falls man pleaded not guilty Thursday in Flathead District Court to what would be his fourth offense of drunken driving.

According to a court document, a Kalispell police officer made contact with Daniel Malloy after responding to a report of an intoxicated driver at a Zip Trip gas station on U.S. 93. 

When the officer arrived, Malloy was in the custody of a Flathead County deputy and a Montana Highway Patrol trooper.

The officer reported Malloy’s eyes were red and glossy and that Malloy smelled of alcohol.

Malloy allegedly failed field sobriety tests and a later breath alcohol test.

His prior convictions for DUI came in February 1996, March 2007, and August 2009.

If convicted, Malloy faces up to five years in prison and a fine of between $1,000 and $10,000. His next hearing is set for June 12.
