Kalispell driver challenges vehicular assault charge

A Kalispell man has pleaded not guilty to a felony charge of negligent vehicular assault after a crash late last year.

Taurean Love, 28, entered the plea March 27 in Flathead District Court.

According to a court document, a Montana Highway Patrol trooper responded to a two-vehicle crash on Montana 35 at 1 a.m. on Dec. 20, 2013. He discovered a woman had been southbound when another vehicle crossed into her lane and struck her head on.

The vehicle that hit her allegedly was driven by Love.

Love allegedly admitted drinking prior to the accident but would not remember what had happened. A blood test reportedly showed Love’s blood-alcohol content was nearly twice the legal limit.

In addition, the trooper found no tire marks leading up to the point of impact.

The woman suffered a broken right elbow and a bruised lung.

If convicted, Love faces up to 10 years of incarceration and a fine of up to $10,000 as well as restitution.

He was initially incarcerated in the Flathead County Detention Center with bond set at $25,000, but he was later released on his own recognizance with the requirement that he participate in the 24/7 Sobriety Program, through which he must take two breath-alcohol tests each day.

His next hearing is set for May 7.
