Arraignment delayed for man involved in shooting
The arraignment was delayed Thursday for a Kalispell man charged with felony assault on an officer.
Ryan Pengelly was charged after a Jan. 12 confrontation with Kalispell Police inside his home where he was shot multiple times by officers.
The arraignment was moved to March 16 at the request of Pengelly, who asked for a continuance because of matters outside of his control, according to his attorney’s motion to the court.
Pengelly allegedly emerged from a bedroom with a loaded gun and pointed it at officers who were trying to restrain his mother and take her into custody for mental-health reasons.
Kalispell Police say Pengelly pointed the gun at officers and did not drop it when told to do so.
Pengelly has countered that he didn’t know the uniformed officers were police and that he wasn’t given time to drop the gun.
