D2017.3.19 NOTICE OF APPLICATION AND INTERVENTION DEADLINE On March 3, 2017, Flathead Utility Company ("Flathead Utility") submitted a request to the Montana Public Service Commission ("Commission") for approval to adopt the standard rate tariff for metered small water utility rates for Country Estates Subdivision ("Country Estates") in Kalispell, MT, and for Hilltop Terrace Subdivision ("Hilltop Terrace") in Columbia Falls, MT. Flathead Utility's request included flat rate charge of $40 per month per connection, plus $2.00 per 1,000 gallons for customer usage in excess of 10,000 gallons; and Standard Ancillary Charges for Small Water/Sewer Utility of $25 for payment refused as a result of insufficient funding, $50 reconnection charge, and 1% per month on interest on past due balances. On February 24, 2017, Flathead Utility mailed the Hilltop Terrace, Country Estates, and Country View Estates water customers notice of the request to the Commission for approval of the rate request and indicated the average customer will see an increase from $15 to $40 per connection per month. Based on recent comments received from customers and the Commission's review of prior annual reports for Flathead Utility, the Commission's staff decided on April 17, 2017 to notice the application for intervention by any interested parties and setup a procedural schedule prior to making a decision on whether to permit the utility to implement standard rates. The Commission is required to ensure that adoption of the standard rate tariff by a water utility that has been operating pursuant to Commission-approved rates would not result in unjust and unreasonable rates. BOX 1415 WHITEFISH, MT 59937 (406) 862-5415, FAX (406) 892-6606 T-Bend Construction proposes to amend their existing 19-acre gravel pit permit on the above described land to add an additional 12.1 acres. T-Bend operates an asphalt plant at this location and imports sand and gravel material to feed the plant from offsite sources. Access to the site is gained directly from Hodgson Road and no changes are proposed. The pit would be operated intermittently from 6:00 AM to 8:00 PM, Monday through Saturday. The site has been operated since 1990 and would continue to operate off and on over the next 30 years. In all, approximately 350,000 cubic yards of sand and gravel has been removed from this site. Of that volume, approximately 17,000 cubic yards are soils that covered the site, which has remained on site for reclamation. The rest were sand and gravel products. The soil will be replaced and planted back to pasture grass when reclamation is completed. Facilities that move in and out include an asphalt plant, screens, dozers, scrapers, haul trucks, fuel trucks, road watering and other equipment typical of paving operations and construction.
