No. 24138 NOTICE OF CLASS ACTION SETTLEMENT WITH PPL MONTANA, LLC AND THE MATTSON PLAINTIFF CLASS OF PROPERTY OWNERS ON THE SHORELINE OF FLATHEAD LAKE AND THE BANK OF FLATHEAD RIVER A group of landowners on Flathead Lake and a portion of the Flathead River located in Flathead County filed a class action lawsuit in the Montana Eleventh Judicial District Court, Kalispell, Montana on November 9, 1999 against Montana Power Company ("MPC") and PPL Montana, LLC ("PPLM"). The landowners claimed the power companies' operation of the Kerr Dam caused damages to the landowners' property. The lawsuit is captioned Mattson, et al. v. Montana Power Co., et al., No. DV-99-548A. The Court certified the class which includes the following group of landowners: All persons and entities (other than the United States, the defendants, and the Confederated Salish and Kootenai Tribes of the Flathead Reservation, Montana) that have since November 9, 1991 to December 1, 2006, owned real property either: i) with frontage on the shoreline of Flathead Lake in Flathead County or Lake County, Montana, or ii) which contains a bank of the Flathead River located in Flathead County, Montana, south of the point at which Lower Valley Road (east of U.S. Highway 93) intersects with the Flathead River, or both. This notice is to advise the class that a hearing will be held on March 9, 2017, at 10:00 a.m. at the Montana Eleventh Judicial District Court for Flathead County, 920 South Main, Kalispell, Montana, 59901. The purpose of the hearing is to determine whether the Court should grant approval of the Amended Stipulation of Settlement and General Release between PPLM and the class as fair, reasonable and adequate, whether the application for award of attorney's fees and reimbursement for expenses should be approved, and whether the case should be dismissed with prejudice. A class settlement with MPC and its insurer National Union Fire Insurance Company of Pittsburgh, PA was previously approved by the Court on August 19, 2015. A Supplemental Notice of Class Action Settlement with PPLM describes a proposed plan of distribution and the rights of class members to file a Proof of Claim and Release ("Claim Form") to receive proceeds from the Settlement Fund from this settlement with PPLM and the earlier settlement with MPC. Claim Forms must be postmarked by May 8, 2017. No. 24147 REQUEST FOR PROPOSAL Proposal for replacing the current phone system with a VOIP Phone System will be received by the Superintendent of Schools, 501 6th. Ave. West, Columbia Falls, Montana until 3:00 PM [MST] March 17, 2017, publicly opened and read aloud on the same day and time in the Conference Room, and taken under advisement. A recommendation to accept or reject the proposals will be made to the Board of Trustees at the next regular Board meeting scheduled for April 10, 2017. All proposals must be plainly marked "VOIP Phone System, School District No. 6 ". The Board of Trustees of School District No. 6 reserves the right to reject any and all proposals, to waive formalities, and to accept the proposal deemed most advantageous to the School District. The major components of the VOIP Phone System (Voice over Internet Protocol), as identified by Columbia Falls School District 6 are detailed below. Vendors responding should be prepared to provide a solution to the specified areas, and if after review and questions add any additional components deemed necessary to successfully complete the project. There are approximately 300 phones currently installed through the District. The proposal should include costs for replacing the handsets currently in use (most are simple handsets, with approximately 10 higher-function sets) or utilizing them in the new system. However, the preference given to resident bidders of this state must be equal to the preference given in the other state or country and must further pay the prevailing wage rates to workers performing labor on the contract if the contract exceeds $25,000.00. Prevailing wage rates are determined by the Commissioner of Labor as provided in 18-2-401 and 18-2-402 Montana Code Annotated. The contractor is required to keep wage records to substantiate that prevailing wages have in fact been paid.
