The Deed of Trust encumbers real property ("Property") located at 190 Spotted Bear Road, Martin City, MT 59926 and being more fully described as follows: A TRACT IN THE SOUTHEAST QUARTER OF THE NORTHWEST QUARTER OF SECTION 4, TOWNSHIP 30 NORTH, RANGE 19 WEST, P.M.M., FLATHEAD COUNTY, MONTANA, DESCRIBED AS FOLLOWS: STARTING AT THE SOUTHWEST CORNER OF SAID SOUTHEAST QUARTER OF THE NORTHWEST QUARTER; THENCE NORTH 15` EAST ALONG THE WESTERLY BOUNDARY OF SAID SOUTHEAST QUARTER OF THE NORTHWEST QUARTER, A DISTANCE OF 307 FEET; THENCE SOUTH 89°56` EAST 96.4 FEET TO THE INTERSECTION OF THE EASTERLY BOUNDARY OF HIGHWAY NO. 2 WITH THE SOUTHERLY BOUNDARY OF THE SPOTTED BEAR ROAD, SAID POINT OF INTERSECTION BEING THE TRUE POINT OF BEGINNING OF THE PARCEL OF LAND TO BE DESCRIBED; THENCE SOUTH 89°56` EAST 102 FEET; THENCE SOUTH 16°06` EAST 120 FEET; THENCE SOUTH 89°39` WEST 70 FEET TO A POINT OF INTERSECTION WITH THE EASTERLY LIMIT OF U.S. HIGHWAY NO. 2; THENCE NORTH 31°43` WEST, ALONG THE EASTERLY LIMIT OF U.S. HIGHWAY NO. 2 A DISTANCE OF 143 FEET MORE OR LESS TO THE TRUE POINT OF BEGINNING. The beneficial interest under said Deed of Trust and the obligations secured thereby are presently held by PNC Bank, National Association. The Beneficiary has declared the Grantor in default of the terms of the Deed of Trust and the Promissory Note ("Note") secured by said Deed of Trust due to Grantor's failure to timely pay all monthly installments of principal, interest and if applicable, escrow reserves for taxes and/or insurance as required by the Note and Deed of Trust. The default for which foreclosure is made is grantors' failure to pay when due the following sums: monthly payments beginning March 1, 2016 through April 28, 2017 with 5 payments of $409.97 totaling $2,049.85 and with 9 payments of $381.19 totaling $3,430,71 plus other fees and costs in the amount of $1,193.10; together with title expense, costs, trustee's fees and attorney's fees incurred herein by reason of said default; any further sums advanced by the beneficiary for the protection of the above described real property and its interest therein; and prepayment penalties/premiums, if applicable. By reason of said default, the beneficiary has declared all sums owing on the obligation secured by said trust deed immediately due and payable, said sums being the following, to wit: $21,299.70 with interest thereon at the rate of 9.37500 percent per annum beginning February 1, 2016 in the amount of $2,472.80; plus escrow/impound Overdraft in the amount of $202.11; plus other fees and costs in the amount of $1,193.10; together with title expense, costs, trustee's fees and attorney's fees incurred herein by reason of said default; any further sums advanced by the beneficiary for the protection of the above described property and its interest therein; and prepayment penalties/premiums, if applicable. Due to the defaults stated above, the Beneficiary has elected and has directed the Trustee to sell the above-described property to satisfy the obligation. Notice is further given that any person named has the right, at any time prior to the date last set for the sale, to have this foreclosure proceeding dismissed and the Deed of Trust reinstated by making payment to the Beneficiary of the entire amount then due (other than such portion of the principal as would not then be due had no default occurred) and by curing any other default complained of herein that is capable of being cured by tendering the performance required under the obligation or to cure the default, by paying all costs and expenses actually incurred in enforcing the obligation and Deed of Trust, together with Successor Trustee's and attorney's fees. If the Trustee is unable to convey title for any reason, the successful bidder's sole and exclusive remedy shall be the return of monies paid to the Successor Trustee and the successful bidder shall have no further recourse.
