The City shall publicly open and examine all proposals; provided, however, that no proposal shall be considered unless accompanied by aforementioned monies, check, draft or bond. The City may reject any and all proposals or bids should it deem this for the public good and also may reject the bid of any party who has been delinquent or unfaithful in any former contract or public works project with the City. The monies, check, draft, or bond accompanying any rejected proposals or Bids shall be immediately returned, all others shall be held by the City Clerk until a contract for providing such equipment, as hereinafter described, has been entered into, whereupon the Bid security shall be returned to all unsuccessful Bidders. If selected Bidder fails, neglects, or refuses to enter into said contract or otherwise fails to perform on such contract, then the monies, check, draft, or bond accompanying his Bid, and the amount therein provided shall be declared to be forfeited to the City as provided by MCA § 181204. Pursuant to Section 18-1-102, Montana Code Annotated, the City is required to provide purchasing preferences to resident Montana vendors and/or for products made in Montana equal to the preferences provided in the state of the competitor. The City reserves the right to determine the significance of all exceptions to bid specifications. Products or services that do not meet bid specifications must be clearly marked as an exception to the specifications. Vendors requesting inclusion or pre-approved alternatives to any of these bid specifications must receive written authorization from the Construction and Maintenance Supervisor a minimum of 5 working days prior to the closing of bids. The City reserves the right to reject any and all bids if all bids are rejected to re- advertise under the same or new specifications, or to make such an award as in the judgement of its officials that best meets the City's requirements.
