Protests will be accepted from residents of the county of the proposed location (Flathead), residents of adjoining Montana counties (Lincoln, Glacier, Pondera, Teton, Lewis & Clark, Powell, Lake, Sanders), and residents of adjoining counties in another state if the criteria in 16-4-207(4)(d), Montana Code Annotated (MCA), are met. What information must be included? Protest letters must be legible and contain (1) the protestor's full name, mailing address, and street address; (2) the license number (07-999-2633-001) and the applicant's name (Gold Country Casino II, LLC); (3) an indication that the letter is intended as a protest; (4) a description of the grounds for protesting; and (5) the protestor's signature. A letter with multiple signatures will be considered one protest letter. What are valid protest grounds? The protest may be based on the applicant's qualifications listed in 16-4-401, MCA, or the grounds for denial of an application in 16-4-405, MCA. Examples of valid protest grounds include: (1) the applicant is unlikely to operate the establishment in compliance with the law; (2) the proposed location cannot be properly policed by local authorities; and (3) the welfare of the people in the vicinity of the proposed location will be adversely and seriously affected. How are protests submitted? Protests must be postmarked to the Department of Revenue, Office of Dispute Resolution, P.O. Box 5805, Helena, Montana 59604-5805 on or before August 27, 2018. What happens if the transfer is protested? Depending on the number of protests and the protest grounds, a public hearing will be held in Helena or Coram. All valid protestors will be notified of the hearing's time, date and location. Hearings typically are scheduled within 90 days. A protester's hearing testimony is limited to the grounds in the protester's letter. No. 25586 NOTICE OF PUBLIC HEARING ON A PROPOSED ISSUE OF HEALTH CARE FACILITIES REVENUE BONDS MONTANA FACILITY FINANCE AUTHORITY NOTICE IS HEREBY GIVEN that the Executive Director of the Montana Facility Finance Authority (the "Authority") or his designee, on August 24, 2018, in the offices of the Authority at 2401 Colonial Drive, Third Floor, Helena, Montana 59620, at 11:00 a.m. will hold a public hearing pursuant to the requirements of Section 147(f) of the Internal Revenue Code of 1986, as amended, on a proposal that the Authority issue its health care facilities revenue bonds or notes, in one or more series and in an aggregate principal amount not to exceed $100,000,000 (exclusive of original issue discount or premium) (the "Bonds"), under Montana Code Annotated, Title 90, Chapter 7, Parts 1, 2 and 3, as amended. The proceeds of the Bonds, if issued, will be loaned by the Authority to Kalispell Regional Medical Center, Inc., a Montana nonprofit corporation (the "Borrower"). The Borrower owns and operates certain hospital and health care facilities on an approximately 18-acre campus located at 310 Sunnyview Lane in Kalispell, Montana (the "Facilities"). The proceeds of the Bonds, if issued, will be loaned to the Borrower to be used for one or more of the following purposes: (1) to finance or reimburse the Borrower for costs incurred in the construction, equipping and furnishing of certain improvements to the Facilities, consisting generally of a portion of a new 190,000 square foot pediatric hospital (the "Pediatric Center Project"), the third floor of a 76,000 square foot surgical services tower and a new hybrid operating room, and improvements of existing space in the Facilites and the purchase and installation of additional equipment for the Facilities; (2)(a) to refund the Banc of America Public Capital Corp Program Revenue Note (Kalispell Regional Medical Center, Inc. Project), Series 2014, the proceeds of which were used to finance the costs of acquisition and installation of electronic medical records equipment and software at the Facilities; and (b) to refund the Banc of America Public Capital Corp Program Revenue Note (Kalispell Regional Medical Center, Inc. Project), Series 2016A, the proceeds of which were used to finance the costs of acquisition, construction, installation, equipping and furnishing of certain improvements to the Facilities, consisting generally of the construction of two floors of a 76,000 square foot surgical services tower, the expansion of radiation oncology facilities and the construction of a new parking lot, and the acquisition and installation of equipment at the Facilities; and (c) to refinance certain other outstanding indebtedness, the proceeds of which were used to provide short-term construction financing for the Pediatric Center Project; (3) to fund a deposit to a debt service reserve fund for the Bonds; and (4) to pay costs of issuance of the Bonds. The foregoing improvements to the Facilities, including the Pediatric Center Project, will be owned and operated by the Borrower and located on the Borrower's campus. If the Bonds are issued and the proceeds thereof loaned to the Borrower as proposed, the Borrower will agree to repay the loan at times and in amounts sufficient to provide for the prompt payment of the principal of, premium, if any, and interest on the Bonds when due. The Bonds will be payable from and secured by a pledge of the loan repayments from the Borrower. The Bonds may also (but need not be) secured by additional collateral as may be provided by the Borrower. The Bonds, if issued, shall be special, limited obligations of the Authority payable solely from the loan repayments and amounts realized from the enforcement of any mortgage or other security interest provided by the Borrower. The Bonds shall not constitute or give rise to a pecuniary liability of the State of Montana or a charge against its general credit or taxing powers. The Authority makes reasonable accommodations for any known disability that may interfere with a person's ability to participate in public meetings.
