No. 25883 DEPARTMENT OF PUBLIC SERVICE REGULATION BEFORE THE PUBLIC SERVICE COMMISSION OF THE STATE OF MONTANA IN THE MATTER OF the Application of Big Mountain Water Company for Authority to Increase Rates and Charges for Water Service in its Service Area in Whitefish, Montana REGULATORY DIVISION DOCKET NO. D2018.6.40 NOTICE OF PUBLIC HEARING, SETTLEMENT, AND OPPORTUNITY TO REQUEST ADDITIONAL PROCESS On July 31, 2018, Big Mountain Water Company ("Big Mountain") filed an application with the Montana Public Service Commission ("Commission") for approval to increase its rates for regulated water services in Whitefish, Montana, pursuant to Title 69, Chapter 3 of the Montana Code. Big Mountain proposed to increase its revenue requirement by $11,376 annually, resulting in a 4.24 percent increase from current rates for Big Mountain's estimated 305 affected customers. The monthly bill for a customer utilizing a 5/8 inch meter and 4,500 gallons of usage will increase from $49.16 to $50.68. On October 3, 2018, the Commission issued Procedural Order 7634, which, among other things, established a January 10, 2019 hearing date for this Application. On November 28, 2018, Big Mountain and the Montana Consumer Counsel notified the Commission staff that the parties had reached an all issues settlement regarding Big Mountain's Application. The Agreement indicates that Big Mountain should be authorized to collect a total revenue requirement of $278,764, which represents a total increase of $10,241 from its currently authorized revenue requirement, and is based on a return on equity of 9.5 percent. The parties agree this $10,241 increase shall be allocated among Big Mountain's customer classes as proposed in the Application. This agreement represents a 3.81 percent increase from Big Mountain's currently authorized revenue requirement. The Commission must announce a hearing on the proposed change and must inform interested parties as to how they may petition the Commission to become parties to the hearing. Mont. Code Ann. § 69-3-303(1). After noticing a hearing, the Commission must conduct the hearing under the Montana Administrative Procedures Act ("MAPA"). Mont. Code Ann. § 693303(2). MAPA permits the Commission to resolve contested case proceedings by settlement agreement. Mont. Code Ann. § 2-4-603. As the settlement resolves all outstanding issues of fact and law, the agreed-to revenue requirement increase is modest, and the parties submitted the settlement well in advance of the scheduled hearing, the Commission determines that an evidentiary hearing is only necessary if requested by parties directly affected by Big Mountain's Application. Parties must request the Commission to hold a hearing on Big Mountain's Application no later than January 4, 2019. To notify the Commission, parties must submit: (1) an electronic petition for an evidentiary hearing to the Commission's website at http://psc.mt.gov ("Electronic Filing" under "For Regulated Utilities" tab); (2) a physical copy to the Commission's address, at 1701 Prospect Avenue, P.O. Box 202601, Helena, Montana 59620-2601; (3) a physical copy to the Montana Consumer Counsel's address, at 111 North Last Chance Gulch, Suite 1B, P.O.
