Marin, as Grantors, conveyed said real property to Old Republic National Title Insurance Company, as Trustee, to secure an obligation owed to Mortgage Electronic Registration Systems, Inc., as nominee for Mortgage Research Center, LLC DBA Veterans United Home Loans, as Beneficiary, by Deed of Trust dated March 31, 2017, and recorded on March 31, 2017 as Document No. 201700006579. The beneficial interest is currently held by Lakeview Loan Servicing, LLC. First American Title Company of Montana, Inc., is currently the Trustee. The beneficiary has declared a default in the terms of said Deed of Trust by failing to make the monthly payments beginning October 1, 2017, and each month subsequent, which monthly installments would have been applied on the principal and interest due on said obligation and other charges against the property or loan. The total amount due on this obligation as of September 19, 2018 is $230,883.15 principal, interest totaling $10,902.09, late charges in the amount of $56.41, escrow advances of $2,394.46, and other fees and expenses advanced of $1,635.00, plus accruing interest, late charges, and other costs and fees that may be advanced. The Beneficiary anticipates and may disburse such amounts as may be required to preserve and protect the property and for real property taxes that may become due or delinquent, unless such amounts of taxes are paid by the Grantors. If such amounts are paid by the Beneficiary, the amounts or taxes will be added to the obligations secured by the Deed of Trust. Other expenses to be charged against the proceeds of this sale include the Trustee's fees and attorney's fees, costs and expenses of the sale and late charges, if any. Beneficiary has elected, and has directed the Trustee to sell the above described property to satisfy the obligation. The sale is a public sale and any person, including the beneficiary, excepting only the Trustee, may bid at the sale. The bid price must be paid immediately upon the close of bidding in cash or cash equivalents (valid money orders, certified checks or cashier's checks). The conveyance will be made by Trustee's Deed without any representation or warranty, including warranty of Title, express or implied, as the sale is made strictly on an as-is, where-is basis, without limitation, the sale is being made subject to all existing conditions, if any, of lead paint, mold or other environmental or health hazards. The sale purchaser shall be entitled to possession of the property on the 10th day following the sale. The grantor, successor in interest to the grantor or any other person having an interest in the property, at any time prior to the trustee's sale, may pay to the beneficiary or the successor in interest to the beneficiary the entire amount then due under the deed of trust and the obligation secured thereby (including costs and expenses actually incurred and attorney's fees) other than such portion of the principal as would not then be due had no default occurred and thereby cure the default. The scheduled Trustee's Sale may be postponed by public proclamation up to 15 days for any reason, and in the event of a bankruptcy filing, the sale may be postponed by the trustee for up to 120 days by public proclamation at least every 30 days. The sale is subject to bankruptcy filing, payoff, reinstatement, or other circumstance that affects the validity of the sale. If the sale is set aside or the trustee is unable to convey title for any reason, the successful bidder's sole and exclusive remedy shall be the return of funds paid to the successor trustee, and the successful bidder shall have no further recourse. No. 25770 Area Landowners Board of County Commissioners Re: Public Notification Letter Opencut Mining Permit: Tutvedt 2 Site - Flathead County, Montana To Whom It May Concern: Schellinger Construction Co., Inc. of Columbia Falls, Montana is submitting this letter as our official Public Notification for an amendment to Opencut Mining Permit #1668, the Tutvedt 2 Site, in Flathead County. The pit is located at 3427 Farm to Market Road, Kalispell, MT. Access to the permit area will be directly from the paved approach on Farm to Market Road. Signs will be posted at the pit site. This proposed amendment will allow an increase in acreage to allow the continued mining and processing of materials which will be used for retail aggregate supply and highway projects as needed. The total permitted area will now be 152.8 acres. Only 80 acres will be active at any time. All conditions of the approved Flathead County Conditional Use Permit will be followed. The depth of excavation is estimated to be 35 feet from the existing ground surface level. Approximately 8" of topsoil will be stripped, salvaged and used for final reclamation. Continued mining at the site in the amended area will commence in the late fall/early winter of 2018. Our current projection is to remove approximately 1.5 million cubic yards of material from this site over the life of the permit. Final reclamation, which includes re-establishment of vegetation, will be completed by December of 2040. The legal description of this site is: Section 16, Township 29N, Range 22W, Flathead County Send any questions, concerns or map requests regarding the amendment to the Tutvedt 2 Site to: Schellinger Construction Co., Inc.
