No. 26167 NOTICE OF PUBLIC HEARING KALISPELL CITY PLANNING BOARD AND ZONING COMMISSION May 14, 2019 The regular meeting of the Kalispell City Planning Board and Zoning Commission is scheduled for Tuesday May 14, 2019, beginning at 6:00 PM in the Kalispell City Council Chambers, Kalispell City Hall, 201 First Avenue East, Kalispell. The planning board will hold a public hearing and take public comments on the agenda items listed below: File #KPP-19-01 - A request from the Montana Department of Natural Resources for a major subdivision to be known as Snowline. The request would subdivide an 8.3-acre piece of remaining tract land into 1 lot. Although only a 1-lot subdivision, a major preliminary plat is required because the remaining parcel of land is part of a tract that has already been subdivided more than five times. The lot proposed to be subdivided is part of section 36, which is primarily owned and managed by the Montana Department of Natural Resources and Conservation for the benefit of Montana's school trust. The proposed subdivision site is zoned B-5/PUD, a mixed commercial zoning district originally adopted in 2001 and amended in 2003 (DNRC - Spring Prairie KPUD-03-01). The subject property is located along Treeline Road, north of Bloomstone, west of Kidsports and south of the new My Place hotel. The property can be legally described as an 8.3-acre portion of Tract 4 located in the NE4 SW4 of Section 36, Township 29 North, Range 22 West, P.M.M., Flathead County, Montana. File #KA-19-01 - A request from Timothy and Naomi Stutzman to annex a 2.8-acre parcel into the city and zone the land R-4 (Residential) upon annexation. Currently, the northern portion of the property is within the city and zoned city R-1. The southern portion of the property is within the county and zoned county R-1. Upon annexation, the entire property is proposed to be zoned city R-4. The property is currently developed with accessory structures; however, a majority of the property is undeveloped grasslands back to Ashley Creek. Water and Sanitary sewer service are in the vicinity of the property and upon annexation extensions can be constructed to serve the property when development is requested. The property is located at the 724 Sunnyside Drive. The property to be annexed can be described as Tract 7ABB in Section 19, Township 28 North, Range 21 West, P.M.M., Flathead County, Montana. Documents pertaining to the agenda items are on file for public inspection at the Kalispell Planning Department, 201 First Avenue East, Kalispell, MT 59901, and are available for public review during regular office hours. In addition, information on the agenda items are posted on our website at https://mt-kalispell.civicplus.com/250/Planning under planning board "upcoming agenda." Interested persons are encouraged to attend the hearings and present their views and concerns to the Planning Board. Written comments may be submitted to the Kalispell Planning Department at the above address, prior to the date of the hearing or work session, or you may call us at (406) 758-7940, or e-mail us at planning@kalispell.com for additional information. /s/Thomas R. Armstrong, as grantor ("Grantor"), to Alliance Title and Escrow Corp., as trustee, in favor of Wells Fargo Bank, N.A., as beneficiary, and recorded on May 26, 2006 as Instrument No. 200614611190, official records of Flathead County, Montana. The Deed of Trust was assigned for value to U.S. Bank National Association, as Trustee for Citigroup Mortgage Loan Trust 2006-WFHE2, Asset-Backed Pass-Through Certificates, Series 2006-WFHE2 ("Beneficiary"), the current beneficiary, by written instrument filed for record on February 4, 2014, as Instrument No. 201400002327, official records of Flathead County, Montana. Brigham J. Beneficiary has declared the grantor in default of the terms of the Deed of Trust and the promissory note ("Note") secured by the Deed of Trust because of Grantor's failure to timely pay all monthly installments of principal, interest, and, if applicable, escrow reserves for taxes and/or insurance as required by the Note and Deed of Trust. According to the Beneficiary, the obligation evidenced by the Note is now due for the December 1, 2018 installment payment. This amount includes the outstanding principal balance of $46,004.96, plus accrued interest, accrued late charges, accrued escrow installments for insurance and/or taxes (if any), and advances for the protection of the beneficiary's security interest (if any). The bid price must be paid immediately upon the close of bidding in cash or cash equivalents (valid money orders, certified checks or cashier's checks). The conveyance will be made by Trustee's Deed without any representation or warranty, including warranties of title or possession, express or implied, as the sale is made strictly on an as-is, where-is basis, without limitation, the sale being made subject to all existing conditions, if any, of lead paint, mold or other environmental or health hazards. The sale is subject to bankruptcy filing, payoff, reinstatement, or other circumstance that affects the validity of the sale. If the sale is set aside or the trustee is unable to convey title for any reason, the successful bidder's sole and exclusive remedy shall be the return of funds paid to the successor trustee, and the successful bidder shall have no further recourse. The purchaser shall be entitled to possession of the property on the 10th day following the sale. The scheduled Trustee's Sale may be postponed by public proclamation up to 15 days for any reason, and in the event of a bankruptcy filing or other court-ordered stay, the sale may be postponed by the trustee for up to 120 days by public proclamation at least every 30 days. The grantor, the successor-in-interest to the grantor, or any other person having an interest in the aforesaid property, at any time prior to the trustee's sale, may pay to the present beneficiary the entire amount then due under the Deed of Trust and the obligation secured thereby (including costs and expenses actually incurred and attorney's fees) other than such portion of the principal as would not then be due had no default occurred and thereby cure the default theretofore existing. This communication is from a debt collector. It is an attempt to collect a debt, and any information obtained will be used for that purpose. DATED: 04/23/2019 /S/ Brigham J. Lundberg Brigham J.
