No. 25940 NOTICE OF PASSAGE OF RESOLUTION OF INTENTION FLATHEAD COUNTY ZONING REGULATIONS The Board of Commissioners of Flathead County, Montana, herby gives notice, pursuant to Section 76-2-205(5), M.C.A., that it passed a resolution of intention (Resolution No. 955IA) on January 28, 2019 to amend the text of the Flathead County Zoning Regulations. The character of many of the proposed amendments can generally be described as ensuring consistency in language throughout the regulations and to rearrange the placement of use districts in a more logical order. More significant amendments include, but are not necessarily limited to: eliminating zoning use districts from the regulations, renaming other zoning use districts, redefining various use districts, and permitted and conditional uses to various use districts, complete revision of the sign regulations, and adding and deleting definitions. BE IT FURTHER RESOLVED that notice of passage of this resolution on the text amendments to the Flathead County Zoning Regulations are on file in the Office of the Board of Commissioners, and that for thirty (30) days after the first publication thereof, the Board of Commissioners will receive written protests to the amendments of the Flathead County Zoning Regulations, and that this notice shall be published once a week for two weeks. No. 25927 NOTICE OF TRUSTEE'S SALE TO BE SOLD FOR CASH AT TRUSTEE'S SALE on April 24, 2019, at 11:00 AM on the front steps of the Flathead County Courthouse, 800 South Main Street, Kalispell MT 59901, the following described real property situated in Flathead County, Montana: Lot 27 of Lonepine View Estates, Phase 2, according to the map or plat thereof on file and of record in the office of the Clerk and Recorder of Flathead County, Montana. The public may protest this new license in accordance with the law. Who can protest this transfer? Protests will be accepted from residents of the county of the proposed location (Lake), residents of adjoining Montana counties (Flathead, Lincoln, Glacier, Pondera, Teton, Lewis & Clark, Powell, Sanders), and residents of adjoining counties in another state if the criteria in 16-4-207(4)(d), Montana Code Annotated (MCA), are met. What information must be included? Protest letters must be legible and contain (1) the protestor's full name, mailing address, and street address; (2) the license number (15-999-3702-002) and the applicant's name (Abar Montana, LP); (3) an indication that the letter is intended as a protest; (4) a description of the grounds for protesting; and (5) the protestor's signature. A letter with multiple signatures will be considered one protest letter. What are valid protest grounds? The protest may be based on the applicant's qualifications listed in 16-4-401, MCA, or the grounds for denial of an application in 16-4-405, MCA. Examples of valid protest grounds include: (1) the applicant is unlikely to operate the establishment in compliance with the law; (2) the proposed location cannot be properly policed by local authorities; and (3) the welfare of the people in the vicinity of the proposed location will be adversely and seriously affected. How are protests submitted? Protests must be postmarked to the Department of Revenue, Office of Dispute Resolution, P.O. Box 5805, Helena, Montana 59604-5805 on or before March 4, 2019. What happens if the transfer is protested? Depending on the number of protests and the protest grounds, a public hearing will be held in Helena or Bigfork. All valid protestors will be notified of the hearing's time, date and location. Hearings typically are scheduled within 90 days. A protester's hearing testimony is limited to the grounds in the protester's letter. Following the hearing, the Department of Revenue will notify the public whether the license transfer is approved or denied. How can additional information be obtained? No. 25939 BUDGET AMENDMENT PROCLAMATION WEST VALLEY SCHOOL DISTRICT NO. 1 FLATHEAD COUNTY At a regular meeting of the board of trustees of School District No. 1, Flathead County, Montana, held January 14, 2019, at 5:00 p.m. at the West Valley School Conference Room, the following resolution was introduced: WHEREAS, the trustees of School District No. 1, Flathead County, Montana, have made a determination that as a result of an increase in enrollment, the district's budget for the general fund(s) does not provide sufficient financing to properly maintain and support the district for the entire current school fiscal year; and WHEREAS, the trustees have determined that an amendment to the state elementary school general fund budget in the amount of $ 60,000.00 is necessary under the provision of Section 20-9-161, subsection (1), MCA; for the purpose of hiring additional classroom support, additional classroom supplies/textbooks; and WHEREAS, the anticipated source of financing the budget amendment expenditures shall be the general fund reserve and additional Direct State Aid; THEREFORE BE IT RESOLVED that the Board of Trustees of School District No. 1, Flathead County, Montana, proclaims a need for an amendment to the state elementary general fund budget for fiscal year 19 in the amount of $60,000.00 under Section 20-9-161, subsection (1), MCA, for the purpose identified above, and; BE IT FURTHER RESOLVED that the Board of Trustees of School District No. 1, Flathead County, Montana, will meet at 5:00 p.m. at West Valley School Conference Room on February 11, 2019, for the purpose of considering and adopting the budget amendment.
