REQUEST FOR THE RELEASE OF FUNDS On or about July 1, 2019, the Montana Department of Commerce will submit a request to the U.S. Department of Housing and Urban Development (HUD) on behalf of Homeword, Inc. for the release of HOME Investment Partnerships (HOME) funds under Title II of the Cranston-Gonzalez National Affordable Housing Act of 1990, as amended, to undertake a project known as Alpenglow Apartments, for the purpose of new construction of thirty-eight (38) multi-family rental housing units, located at 530 Edgewood Place, Whitefish, Montana, using $862,307 in HOME Investment Partnerships Program (HOME) funds and $630,000 in Housing Trust Fund assistance to complete the $8,199,514 project in partnership with Homeword Inc.. FINDING OF NO SIGNIFICANT IMPACT The Montana Department of Commerce has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at Montana Department of Commerce, 301 S Park Ave, Helena, MT, 59620-0523 and Homeword, Inc., 1535 Liberty Lane Suite 116A, Missoula, MT, 59808-2026. RELEASE OF FUNDS The Montana Department of Commerce certifies to the US Department of Housing and Urban Development that Tara Rice in her capacity as the Director consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The US Department of Housing and Urban Development approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows Montana Department of Commerce to use HOME Program and Housing Trust Fund Program funds. OBJECTIONS TO THE RELEASE OF FUNDS The US Department of Housing and Urban Development will accept objections to its release of funds and the Montana Department of Commerce's certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are made on one of the following bases: (a) the certification was not executed by the Certifying Officer of the Certifying Officer of the Montana Department of Commerce; (b) the Montana Department of Commerce has omitted a step or failed to make a decision or finding required by US Department of Housing and Urban Development regulations at 24 CFR Part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before the approval of a release of funds by the US Department of Housing and Urban Development; or (d) another Federal agency, acting pursuant to 40 CFR Part 1504, has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Former students may contact the Special Education Department at (406) 751-3408 within sixty days of the first publication of this notice if they wish to review the files or obtain copies of the information contained in them. The information to be destroyed shall not include data collected on a routine basis that is maintained on all school children (such as the student's name, address, telephone number, grade level completed and year completed). The data to be destroyed shall include information collected for identification, location, evaluation and other items directly related to special education services which the student had received. Parents of students still in school but no longer receiving special education services may also request that their children's records be destroyed. Parents of these students also have the right to inspect the special education records and obtain copies of the information contained in those records before they are destroyed.
