No. 26136 NOTICE OF PUBLIC HEARING The Board of Commissioners of Flathead County, Montana hereby give notice, pursuant to Section 76-2-205(1), M.C.A., that it will hold a public hearing to consider a request by Saddlehorn II & III, LLC to amend the text of the Saddlehorn Planned Unit Development (PUD). The proposed amendment would add a conditional use, remove permitted uses, and allow for a shared driveway. The proposal would amend the text of the Saddlehorn PUD to read: Permitted Uses in the PUD will be: Dwelling, single family detached; Dwelling, single family attached; Guest House; Homeowners Park; Camp and retreat center; Caretakers facilities; Recreation facilities, low impact; Water storage facilities. Conditional Uses in the PUD will be: Short Term Rental Housing¹ ¹Administrative Conditional Use Permit (Per Zoning Ordinance) Allow for shared driveways with other lots, up to three if the purpose is to minimize disturbance caused by constructing a driveway only on one lot. The Saddlehorn PUD applies to the Bigfork Zoning District, created under Section 76-2-205, M.C.A., and is on file for public inspection at the Office of the Clerk & Recorder, 800 South Main, Kalispell, Montana, at the Flathead County Planning and Zoning Office, 40 11th Street West, Kalispell, Montana and online at: http://flathead.mt.gov/planning_zoning/zoning.php. Documents related to the proposed amendments to those regulations are on file for public inspection at the Commissioners' Office and at the Flathead County Planning and Zoning Office. The public hearing will be held on the 29th day of May, 2019, at 10:00 o'clock a.m. in the Commissioners' Chambers, Third Floor, Old Courthouse, Kalispell, Montana. At the public hearing, the Board of Commissioners will give the public an opportunity to be heard regarding the proposed change to the text of the Saddlehorn PUD in the Bigfork Zoning District. No. 26201 INVITATION TO BID FLATHEAD COUNTY SOLID WASTE DISTRICT PHASE 1 - ENTRANCE FACILITY CONSTRUCTION PROJECT Notice is hereby given that the Flathead County Solid Waste District will receive bids for the construction of the Phase 1 - Entrance Facility Construction Project. Work primarily consists of clearing, grubbing, earthwork, road subgrade reconditioning, cold planning asphalt, new subbase and base gravel, new asphalt pavement, utility conduits, fencing, and miscellaneous items. The proposed project is located in Flathead County, MT, approximately 4.8 miles north of the City of Kalispell, MT. All sealed bids plainly marked "Flathead County Solid Waste District: Phase 1 - Entrance Facility Construction Project" must be delivered to the Flathead County Solid Waste District, 4098 Highway 93 North, Kalispell, Montana 59901, at or before 11:00 a.m., local time, Wednesday, May 22, 2019. All Bids that have been duly received will be opened and read aloud immediately thereafter at the Flathead County Solid Waste District Office. All Bids must be in accordance with the Contract Documents on file at the following locations: Flathead County Solid Waste District Office, 4098 Highway 93 North, Kalispell, MT (406) 758-5773 and designated Plans Exchanges. Contract Documents for use in preparing Bids may be obtained from Flathead County Solid Waste District Office at the address listed above upon receipt of a non-refundable deposit of $95.00, payable to SWT Engineering for each set of documents including drawings. Prospective bidders must obtain or request Contract Documents no later than the day prior to bid opening. All sealed bids must be submitted on original forms. Copies of the Contract Documents obtained from other sources shall not be accepted. No bids shall be withdrawn for a period of 60 days after the scheduled closing time for receipt of bids. Each bidder must deposit with his bid, a bid security in the amount of ten percent (10%) of the bid to secure the bidder's express covenant that if the bidder is awarded the contract, the bidder will, within fourteen (14) days following the notice of award, enter into a formal contract for completion of the project. Bid security shall be payable to Flathead County Solid Waste District and shall be in the form of lawful money of the United States, as cashier's check, certified check, bank money order, or bank draft issued by a Montana bank, or bid bond executed by a surety corporation authorized to do business in Montana. A performance Bond and Labor and Materials Payment Bond each in the amount of One Hundred percent (100%) of the contract sum will be required of the successful bidder, to secure the contractor's covenant to faithfully perform all of the conditions of the contract in accordance with the law and that contract. The successful bidder must contract to pay prevailing wage rates, set by the Montana Department of Labor, and will be subject to withholding of 1% of all payments for transmittal to the Department of Revenue to pay the public contract tax. No bid shall be considered that does not carry the bidder's Montana Contractor's Registration Number on the bid form. A pre-bid conference will be held at the Flathead County Solid Waste District Office commencing at 10:00 A.M. on Friday, May 17, 2019. Those interested in bidding the project are encouraged to attend this meeting. Completion of the work is required within 60 calendar days after commencement on approximately June 24, 2019 and according to the construction schedule to be determined after the Notice to Proceed is issued. The project includes liquidated damages that will be assessed as set forth in the Special Provisions at $500.00 per calendar day, in addition to any damages required under the Contractor Reimbursed Engineering Costs Section of the Supplementary Conditions if the work is not complete within the allotted contract time. Flathead County reserves the right to accept or reject any bid, to waive any irregularities, and to accept the lowest responsive and responsible bid which is deemed to be in the best interest of the County.
