No. 27357 Legal Notice Comprehensive Five-Year Bond Review for Imerys Talc America, Inc. (Hard Rock Mining Operating Permit No. 00127) The Department of Environmental Quality (DEQ) is conducting a comprehensive bond review for Operating Permit No. 00127 issued to Imerys Talc America, Inc (Imerys). Imerys' Sappington Mill facility and associated disturbances are located in Gallatin County, approximately 15 miles southwest of Three Forks, in Section 31 of Township 01 North, Range 01 West. DEQ has determined that the current bonding level does not represent the present costs of compliance with the Metal Mine Reclamation Act, administrative rules adopted thereunder, and the operating permit. DEQ is proposing a bond adjustment from $202,175 to $112,351. This amount reflects a decrease in the bond required for Operating Permit No. 00127, based upon the following changes: updated material inventories for ore stockpiles and chemical waste; the slurry system has been decommissioned and cleaned; and a revised strategy for disposing of remnant ore stockpiles at closure was approved as permit revision #20-002. The procedure for adjusting bonds as a result of a comprehensive bond review is set forth in Section 82-4-338(3), MCA. The company and the public will have until December 4, 2020 to comment on the proposed bond decrease. DEQ will issue a final bond determination after the comment period has expired. The company, or any person with an interest that may be adversely affected by DEQ's final bond determination, may obtain a contested case hearing before the Board of Environmental Review. A written request for a hearing must be filed with DEQ within 30 days of the issuance of the final bond determination, stating the reason for the request. MT-20-14 November 2, 2020 PURPOSE OF PUBLIC NOTICE The purpose of this notice is to state the Montana Department of Environmental Quality's (DEQ) intention to issue a General Permit as described in this notice. This permit is issued by the DEQ under the authority of 75-5-402, Montana Code Annotated (MCA); the Administrative Rules of Montana (ARM) 17.30.1301 et seq., Montana Pollutant Discharge Elimination System (MPDES); and Sections 402 and 303 of the Federal Clean Water Act. The Water Protection Bureau has prepared a draft permit for the facility listed below. The renewal is for a five-year cycle. This PWGP only permits the discharge of produced water for beneficial use, specifically for wildlife and livestock watering. The permit includes effluent limits and has two prerequisites: a receiving water storage capacity self-evaluation to ensure discharge is contained in ephemeral drainages , and a water quality analysis to ensure the produced water is of high enough quality for wildlife and livestock watering. Indian Lands, National Parks, and the state waters in Rosebud Creek, Tongue, Powder, and Little Powder River watersheds are excluded from General Permit coverage. The Water Protection Bureau has prepared a draft permit for the facility listed below. RECEIVING WATER: Class I ground water PERMIT NUMBER: MTX000213 A determination has been made by DEQ to reissue a Montana Ground Water Pollution Control System (MGWPCS) permit, MTX000213, to the Peak Health and Wellness Center. This permitting action authorizes discharge of treated wastewater to ground water. The scope of this permitting action is for the operation and maintenance of the existing wastewater treatment and disposal system. This renewal is for a 5-year period for the continued operation of a Level 2 Sequencing Batch Reactor (SBR) wastewater treatment system. DEQ recognizes that in comparison to conventional septic treatment, the Level 2 treatment system may provide a higher level of treatment for nutrients and pathogens. The facility utilizes a multi-zone pressurized subsurface drainfield (Outfall 001) to discharge treated wastewater. The applicant is proposing to add two outfalls to the system (Outfall 002 and Outfall 003). The maximum design flow for Outfall 001 is 12,136 gallons per day (gpd), Outfall 002 is 4,500 gpd, and Outfall 003 2,000 gpd.
