No. 27962 Service Date: July 30, 2021 DEPARTMENT OF PUBLIC SERVICE REGULATION BEFORE THE PUBLIC SERVICE COMMISSION OF THE STATE OF MONTANA IN THE MATTER OF the Petition of Qwest Corporation d/b/a CenturyLink QC to Eliminate the Performance Indicator Definitions and Performance Assurance Plan Portions of its Interconnection Agreements with Montana Competitive Local Exchange Carriers REGULATORY DIVISION DOCKET NO. 2021.07.102 NOTICE OF PETITION AND OPPORTUNITY TO INTERVENE PLEASE TAKE NOTICE that on July 13, 2021, Qwest Corporation d/b/a CenturyLink QC ("CenturyLink") filed a Petition with the Montana Public Service Commission ("Commission"), which requests that the Commission issue an order to eliminate the Performance Indicator Definitions ("PIDs") and Performance Assurance Plan ("PAP") portions of its interconnection agreements ("ICA's") with each Competitive Local Exchange Carrier ("CLEC") in Montana. The PAP is a self-effectuating performance assurance plan which was established in the early 2000's as part of CenturyLink's effort to obtain approval from the Federal Communications Commission ("FCC") to enter into the long distance telecommunications market. The PAP contains terms and conditions for interconnection and unbundled network elements, including PIDs, meant to provide additional assurance to CLECs of continued interconnection and network access between CenturyLink and CLECs. In 2019 and 2020, the FCC issued orders which significantly reduced almost all of the PIDs and PAP over various product timelines. Petition at 3. CenturyLink argues that it would be cost prohibitive to compile competition metrics at the rate center level and its existing ICAs, which would be required for CenturyLink to be in compliance with the FCC's 2020 order. Id. The Petition states CenturyLink has notified impacted CLECs of its intent to eliminate the PIDs and PAP. Id. The Petition states that payments to CLECs under the PAP were $0 in 2019, 2020, and 2021 year-to-date. Petition at 5. CenturyLink believes that the decline in services covered by the PIDs and PAP combined with the cost to update all of the necessary documentation and systems warrants their elimination completely. Petition at 6.
