No. 27964 CITY OF WHITEFISH NOTICE OF PUBLIC HEARING ON BUDGET AND PROPERTY TAXES AND ASSESSMENTS The Whitefish City Council has completed the City's preliminary budget for fiscal year 2022, its proposed final budget for fiscal year 2022, the appropriations, tax levy and assessments, and budget amendments for fiscal year 2021, which have been placed on file and are open to inspection in the City Clerk's office located at 418 E. 2nd Street. At the regular meeting of the Whitefish City Council to be held on Monday, August 16, 2021, at 7:10 p.m. in the Whitefish City Council Chambers, 418 E. 2nd Street, the City Council will hold a public hearing for the purposes of receiving public input and approving a final budget, making appropriations, fixing the tax levy and assessments, and approving budget amendments for fiscal year 2021 for the following: 1. amendments to the annual budget for fiscal year 2021; 2. approve a final budget for fiscal year 2022; 3. levy and assess property taxes, including the Permissive Medical Levy; 4. levy and assess Street Maintenance District No. 1 within the City; 5. levy and assess Special Improvement Lighting Districts No. 1 and No. 4 within the City; 6. levy and assess Parkland and Greenway Maintenance District No. 1 within the City; 7. levy and assess Stormwater Improvement and Maintenance District No. 1 within the City; 8. levy and assess Special Improvement District No. 166 (JP Road); 9. levy and assess Special Improvement District No. 167 (Downtown Parking Structure); 10. levy and assess for weed control and/or removal of snow, ice and other impediments; and 11. levy and assess for collection of certain delinquent utility service charges. The City's certified taxable value is projected to increase 7% with the final value provided by the Montana Department of Revenue on August 2, 2021. The City intends to reduce mills to budget an increase in revenue from property taxation by about 2.03% or $87,863. The City also intends to keep all maintenance assessments the same as the prior year. All concerned persons are invited to attend the public hearing on all of the matters as described above. A decision on approving the budget, taxes, assessments, and fiscal year 2021 budget amendments will be made after considering comments at this public hearing. Individuals, any taxpayer, or resident may appear or submit written testimony at the hearings and be heard for or against any part of the proposed fiscal year 2021 budget amendments, final budget for fiscal year 2022, appropriations, tax levy and assessments. No. 27928 PUBLIC OPPORTUNITY TO PROTEST ISSUANCE OF ONE NEW MONTANA ALL-ALCOHOLIC BEVERAGES LICENSE MANY SPRINGS RESORT PARTNERS LLC (Brooktrout, LLC; The Properties, LLC, Edward J. Wetherbee, Leslie Wetherbee; Ruel Mercure, Glacier Mini Storage LLC, ECCW, LLC, Owner(s)) has applied for one new Montana All-Alcoholic Beverages License No. 07-999-2312-002 to be operated at MANY SPRINGS RESORT PARTNERS LLC, 24377 MT Highway 35, Bigfork, Flathead County. The public may protest this license in accordance with the law. Who can protest this license? Protests will be accepted from residents of the county of the proposed location Flathead County, residents of adjoining Montana counties, and residents of adjoining counties in another state if the criteria in 16-4-207(4)(d), Montana Code Annotated (MCA), are met. What information must be included? Protest letters must be legible and contain (1) the protestor's full name, mailing address, and street address; (2) the license number 07-999-2312-002 and the applicant's name MANY SPRINGS RESORT PARTNERS LLC; (3) an indication that the letter is intended as a protest; (4) a description of the grounds for protesting; and (5) the protestor's signature. A letter with multiple signatures will be considered one protest letter. What are valid protest grounds? The protest may be based on the applicant's qualifications listed in 16-4-401, MCA, or the grounds for denial of an application in 16-4-405, MCA. Examples of valid protest grounds include: (1) the applicant is unlikely to operate the establishment in compliance with the law; (2) the proposed location cannot be properly policed by local authorities; and (3) the welfare of the people in the vicinity of the proposed location will be adversely and seriously affected. How are protests submitted? Protests must be postmarked to the Department of Revenue, Office of Dispute Resolution, P.O. Box 5805, Helena, Montana 59604-5805 on or before August 14, 2021. What happens if the license is protested? Depending on the number of protests and the protest grounds, a public hearing will be held in Helena or Bigfork. All valid protestors will be notified of the hearing's time, date and location. Hearings typically are scheduled within 90 days. A protester's hearing testimony is limited to the grounds in the protester's letter. Following the hearing, the Department of Revenue will notify the public whether the license is approved or denied.
