No. 28021 NOTICE OF HEARING ON PROPOSED ASSESSMENTS FOR FLATHEAD EMERGENCY COMMUNICATION CENTER SPECIAL DISTRICT BE IT RESOLVED by the Board of County Commissioners (the "Board") of Flathead County, Montana (the "County"), as follows: Section 1. The District; The County has created the Flathead Emergency Communications Special District pursuant to Montana Code Annotated, Title 7, Chapter 11, Part 10, M.C.A (2019). The boundaries of the Special District are the boundaries of Flathead County. Each lot or parcel of land, including the improvements on the lot or parcel will be assess for that part of the costs of FECC Special District that its taxable valuation bears to the total taxable valuation of the property of the District. Section 2. The levy special assessment is to provide emergency dispatch and support communication services, equipment, and infrastructure for Flathead County and its municipalities. Section 3. The total proposed assessment for the tax year 2021 is $3,539,009.63. The impact of this assessment for the tax year 2021 on a home valued at $100,000 would be approximately $15.96 in additional property taxes; on a home valued at $200,000 the additional property taxes would be approximately $31.91. Section 4. Public Hearing; Objections. The resolution levying a special assessment to defray the cost of the special district is on file in the clerk's office and subject to inspection. The Board will meet on the 14th day of September 2021 at 10:30 a.m. local time for the purpose of hearing objections to the final adoption of the resolution. No. 28003 PUBLIC OPPORTUNITY TO PROTEST TRANSFER OF OWNERSHIP OF MONTANA ALL-ALCOHOLIC BEVERAGES LICENSE SCOREBOARD SPORTS BAR LLC (Tuyen Tran, Owner(s)) has applied to transfer Montana All-Alcoholic Beverages License No. 07-901-2676-002 to be operated at SCOREBOARD SPORTS BAR AND CASINO, 75 Woodland Park Dr, Kalispell, Flathead County. The public may protest this license transfer in accordance with the law. Who can protest this transfer? Protests will be accepted from residents of the county of the proposed location Flathead County, residents of adjoining Montana counties, and residents of adjoining counties in another state if the criteria in 16-4-207(4)(d), Montana Code Annotated (MCA), are met. What information must be included? Protest letters must be legible and contain (1) the protestor's full name, mailing address, and street address; (2) the license number 07-901-2676-002 and the applicant's name SCOREBOARD SPORTS BAR LLC; (3) an indication that the letter is intended as a protest; (4) a description of the grounds for protesting; and (5) the protestor's signature. A letter with multiple signatures will be considered one protest letter. What are valid protest grounds? The protest may be based on the applicant's qualifications listed in 16-4-401, MCA, or the grounds for denial of an application in 16-4-405, MCA. Examples of valid protest grounds include: (1) the applicant is unlikely to operate the establishment in compliance with the law; (2) the proposed location cannot be properly policed by local authorities; and (3) the welfare of the people in the vicinity of the proposed location will be adversely and seriously affected. How are protests submitted? Protests must be postmarked to the Department of Revenue, Office of Dispute Resolution, P.O. Box 5805, Helena, Montana 59604-5805 on or before September 9, 2021. What happens if the transfer is protested? Depending on the number of protests and the protest grounds, a public hearing will be held in Helena or Kalispell. All valid protestors will be notified of the hearing's time, date and location. Hearings typically are scheduled within 90 days. A protester's hearing testimony is limited to the grounds in the protester's letter. Following the hearing, the Department of Revenue will notify the public whether the license transfer is approved or denied. How can additional information be obtained?
