No. 27641 Service Date: March 17, 2021 DEPARTMENT OF PUBLIC SERVICE REGULATION BEFORE THE PUBLIC SERVICE COMMISSION OF THE STATE OF MONTANA IN THE MATTER OF Commission PURPA Rulemaking REGULATORY DIVISION DOCKET NO. 2021.03.037 NOTICE OF COMMISSION ACTION AND OPPORTUNITY FOR COMMENT During a regularly scheduled work session on January 26, 2021, the Commission initiated a rulemaking proceeding to address three issues which frequently arise in contested case proceedings regarding qualifying facilities ("QFs") under the Public Utility Regulatory Policies Act of 1978, as well as relevant state law and Commission regulations. The issues to be addressed in the proceeding are contract length, avoided costs related to carbon dioxide emissions, and the Commission's legally enforceable obligation ("LEO") test codified in Mont. Admin. R. 38.5.1909. Prior to a formal notice of proposed rulemaking published in the Montana Administrative Register, the Commission can request informal comments on potential rulemakings to inform the Commission's proposed rulemaking. The Commission invites public comment from interested parties on these QF issues by April 16, 2021. The Commission welcomes any recommendations and supporting rationale as to how eventual rules should address the identified QF issues, and the Commission requests that commenters address several particular questions and accompanying rationale for each of the issues as listed below: Contract length Recognizing that the current Commission-approved tariff for "QF-1" facilities (i.e., QFs of 3 megawatts ("MW") or less) incorporates a maximum contract length, should the Commission adopt a maximum contract length for QFs larger in nameplate capacity than 3 MW (i.e., "large QFs")? If a maximum contract length for large QFs is considered, should specific contract lengths be adopted for each distinct generating technology, e.g., wind, solar, hydro, or hybrid battery systems? If so, what should those contract lengths be and what justifies differing contract lengths? What minimum contract length allows an investor in qualified facilities to be able to estimate the return on investment with reasonable certainty? What sources and evidence (academic, governmental, judicial, professional papers, regulatory orders from other states, etc.) address this question? Do alternative mechanisms exist for the determination of contract length in addition to the adoption of standard maximum contract length or through a case-by-case approach in contested case proceedings? Is the Commission required to set similar or equal contract lengths for QF and non-QF facilities, respectively? Should the Commission interpret the requirement in Mont. Code Ann. § 69-3-604(2) that long-term contracts must be encouraged to enhance the economic feasibility of QFs as an implementation of PURPA or as a decision by the state to provide further encouragement to QFs, beyond what PURPA provides, and why? Carbon pricing What sources (academic, governmental, judicial, modeling and forecasting results, professional papers, regulatory orders from other states, etc.) should the Commission consider in determining the existence and/or value of the cost of carbon as incorporated into an avoided cost of energy? Should differing sources and estimations of carbon cost be prioritized in any way? If so, how? Should the determination of the existence and/or value of a carbon cost be determined on a case-by-case basis in QF dockets or by the adoption of a rule that standardizes either a value or methodology that could be utilized in all cases? If a standardized approach is preferred, what methodology should be used, what inputs are needed to calculate a value, and what should be the frequency of revision? How should a carbon cost value, if not zero, be considered with respect to the ownership rights and value of the renewable energy credits produced by, or the renewable attributes of, a QF? If an avoided carbon cost is determined to have a relationship with renewable energy credits or renewable energy attributes, how should that relationship be defined by the Commission in the resolution of contract terms and conditions, whether by rule or in a contested QF case? What sources or authorities should the Commission consider in determining the existence and/or value of the renewable energy credits or renewable energy attributes? Legally enforceable obligation How should the Commission incorporate recent guidance provided by both the Montana Supreme Court and FERC on the Commission's current LEO rule? Is the guidance provided by the Montana Supreme Court and FERC consistent from each respective authority? If not, what are the conflicts and how should the Commission resolve them in developing a revised LEO rule?
