Evergreen man charged with assault with weapon

An Evergreen man was charged with assaulting another man with a fiberglass post marker.

Kenneth Dale Mayberry, 53, was charged with assault with a weapon after a May 7 incident on Swan Mountain Drive.

According to the charging document, an officer with the Flathead County Sheriff’s Office arrived at a residence where he spoke with a man who was bleeding from his face and said he was dizzy and couldn’t see out of his left eye.

The man alleged Mayberry struck him in the face with a post marker.

The investigating officer also spoke with another person who said he saw Mayberry strike the victim with the fiberglass marker.

Mayberry was arrested and booked into the county detention center on May 7. His bail was set at $30,000. His arraignment is scheduled for 9 a.m. Thursday, June 17.

Mayberry is on probation for assault with a weapon in 2016 in Missoula County. He was given a seven-year suspended sentence.

According to a Missoulian story, Mayberry was accused of pointing a shotgun at a woman at Lolo Hot Springs.

Mayberry is facing a maximum term of 20 years in the Montana State Prison.
