No. 28066 DEPARTMENT OF PUBLIC SERVICE REGULATION BEFORE THE PUBLIC SERVICE COMMISSION OF THE STATE OF MONTANA IN THE MATTER OF Polson Taxi Company Application for a Certificate Of Compliance as a Class E Transportation Network Carrier in the state of Montana. REGULATORY DIVISION DOCKET NO. 2021.02.019 NOTICE OF COMMISSION ACTION AND PUBLIC HEARING On February 8, 2021, Polson Taxi Company ("PTC") filed with the Montana Public Service Commission ("Commission") an Application for a Certificate of Compliance ("Application") as a Class E Transportation Network Carrier. On February 23, 2021, the Commission noticed PTC's Application and set a March 8, 2021 deadline to protest. There were no protests. On March 11, 2021, Commission staff issued a Notice of Staff Action granting the Authority. Commission staff then sent a letter of compliance advising PTC of the requirements to receive a Certificate of Compliance. The letter notified PTC of the 30-day deadline to meet compliance. PTC has yet to provide proof of adequate insurance for a Class E Certificate of Compliance. At a regularly scheduled business meeting on September 14, 2021, the Commission voted to suspend the Notice of Staff Action that granted PTC's Application. The Commission further voted to schedule hearing for PTC to appear and show cause for its failure to document compliance with the Class E insurance requirement. PLEASE TAKE NOTICE that a hearing is scheduled for October 26, 2021, at 1:00 p.m., at which PTC must appear and show cause for its failure to document compliance with the Class E insurance requirement. The hearing will be held in the Bollinger Room located in the Commission's offices at 1701 Prospect Avenue, Helena, Montana. An appearance in a Commission proceeding is considered the practice of law. Mont. Code Ann. § 37-61-201; Mont. Admin. R. 38.2.314. Business organizations, including corporations and limited liability companies, cannot appear pro se and must be represented by an attorney licensed to practice in Montana. H & H Dev., LLC v. Ramlow, 2012 MT 51, ¶ 18, 364 Mont. 283, 272 P.3d 657. PTC must therefore be represented by a licensed attorney at all Commission hearings, including the October 26, 2021 hearing. The Commission's jurisdiction over PTC is found in Title 69 and Title 2, Chapter 4 of the Montana Code Annotated, and Title 38, Chapters 2 and 5 of the Montana Administrative Rules, and any prior orders of the Commission relevant to the issues presented.
