No. 28826 Bigfork School District 38 will soon destroy special education records of former students who have been out of school for at least 7 years. Former students may contact Matt Porrovecchio at 406-837-7412 within sixty days of this notice if they wish to review the files or obtain copies of the information contained in them. The information to be destroyed shall not include data collected on a routine basis that is maintained on all school children (such as the student's name, address, telephone number, grade level completed and year completed.) The data to be destroyed shall include information collected for identification, location, evaluation, and other items directly related to special education services which the student has received. Parents of student still in school but not in special education for at least five years may also request that their children's records be destroyed. Parents of these students also have the right to inspect the special education records and obtain copies of the information contained in those records before they are destroyed. Persons having questions about this process or those persons wishing to request that records be destroyed may contact Matt Porrovecchio at 406-837-7412 for assistance. In informing parents about their right under this section, Bigfork School District 38, will provide information stating that the records may be needed by the parents of the child in an attempt to obtain social security or other benefits. No. 28808 PUBLIC OPPORTUNITY TO PROTEST TRANSFER OF OWNERSHIP OF MONTANA ALL-ALCOHOLIC BEVERAGES LICENSE CAR BAR LLC (Robert and Brooke Eickert, Owner(s)) has applied to transfer Montana All-Alcoholic Beverages License No. 07-999-2581-002 to be operated at BUFFALO SALOON OF BIGFORK, 5 Swan Way, Bigfork, Flathead County. The public may protest this license transfer in accordance with the law. Who can protest this transfer? Protests will be accepted from residents of the county of the proposed location Flathead County, residents of adjoining Montana counties, and residents of adjoining counties in another state if the criteria in 16-4-207(4)(d), Montana Code Annotated (MCA), are met. What information must be included? Protest letters must be legible and contain (1) the protestor's full name, mailing address, and street address; (2) the license number 07-999-2581-002 and the applicant's name CAR BAR LLC; (3) an indication that the letter is intended as a protest; (4) a description of the grounds for protesting; and (5) the protestor's signature. A letter with multiple signatures will be considered one protest letter. What are valid protest grounds? The protest may be based on the applicant's qualifications listed in 16-4-401, MCA, or the grounds for denial of an application in 16-4-405, MCA. Examples of valid protest grounds include: (1) the applicant is unlikely to operate the establishment in compliance with the law; (2) the proposed location cannot be properly policed by local authorities; and (3) the welfare of the people in the vicinity of the proposed location will be adversely and seriously affected. How are protests submitted? Protests must be postmarked to the Department of Revenue, Office of Dispute Resolution, P.O. Box 5805, Helena, Montana 59604-5805 on or before August 29, 2022. What happens if the transfer is protested? Depending on the number of protests and the protest grounds, a public hearing will be held in Helena or Bigfork. All valid protestors will be notified of the hearing's time, date and location. Hearings typically are scheduled within 90 days. A protester's hearing testimony is limited to the grounds in the protester's letter. Following the hearing, the Department of Revenue will notify the public whether the license transfer is approved or denied. How can additional information be obtained? No. 28836 HELENA FLATS SCHOOL DISTRICT NO. 15 DISPOSAL OF PROPERTY RESOLUTION WHEREAS, Section 20-6-604, Montana Code Annotated, provides in pertinent part: (1) Whenever the trustees of a district determine that a site, building, or any other real or personal property of the district is or is about to become abandoned, obsolete, undesirable, or unsuitable for the school purposes of the district, the trustees may sell or otherwise dispose of the real or personal property. If a decision to sell or dispose of property is made, the trustees shall adopt a resolution to sell or otherwise dispose of the district real or personal property because it is or is about to become abandoned, obsolete, undesirable, or unsuitable for the school purposes of the district. (2) The resolution may not become effective for 14 days after the notice required in subsection (3) is made. (3) The trustees shall provide notice of the resolution in the manner required for school elections in 20-20-204. WHEREAS, pursuant to Section 20-6-604, Montana Code Annotated, the Board of Trustees of Helena Flats_School District, finds the school property obsolete for school purposes. NOW, THEREFORE, BE IT RESOLVED, the Board of Trustees of Helena Flats School District, shall place the following real property on the open market, advertise the real property as being disposed of by the district: (List attached) BE IT FURTHER RESOLVED, in accordance with District practice and as required by Sections 20-6-604 and 20 20-204, Montana Code Annotated, this Resolution shall be posted in three different places in the district and published in The Daily Interlake, the newspaper of general circulation in the district. BE IT FURTHER RESOLVED, the resolution shall become effective fourteen (14) days after such publication and posting if, in accordance with Section 20-6-604, Montana Code Annotated, no taxpayer appeals this Resolution prior to September 1st, 2022 by filing a verified petition with the Clerk of the District Court setting out in detail the objections to the adoption of the Resolution or the disposal of the property and serving a copy of such petition upon the School District. A taxpayer may appeal this resolution of the Trustees during the two week period following this publication. The list of obsolete equipment includes laptops, chromebooks, desktops, iPad and chain link fence.
