No. 28320 INVITATION TO BID CITY OF WHITEFISH SPOKANE AVENUE WATER MAIN REPLACEMENT PROJECT Separate sealed bids for construction of the Spokane Avenue Water Main Replacement Project will be received by the City of Whitefish at 418 E 2nd Street, Whitefish, MT 59937 until 11:00 AM local time on Thursday, February 24, 2022 and then publicly opened and read aloud. The project generally consists of municipal water system improvements along Spokane Avenue (Hwy 93) from 2nd Street to 13th Street in Whitefish, MT. Approximately 3,600 LF of 18" C900 PVC water main is to be installed under Spokane Avenue replacing existing water mains. The new main will tie-in to the existing water distribution system in several locations. Existing residential and commercial water services will be reconnected to the new water main. Sidewalks and curb will be removed and replaced at several intersections to meet current ADA requirements. Multiple fire hydrants will also be replaced. Horizontal directional drilling will be required for some water service connections. Services of a licensed arborist will be required to mitigate damage to existing trees along the project corridor. No. 28324 CALL FOR BIDS Notice is hereby given that sealed bids for the crushing and stockpiling of gravel at Flathead County's Old Steele Bridge (OSB) gravel pit will be received by the County Board of Commissioners of Flathead County, Montana. The work contemplated consists of crushing and stockpiling the following: 1" MINUS CRUSHED GRAVEL WITH BENTONITE Approximately 70,000 tons of 1" inch minus crushed gravel at the OSB Pit in Flathead County. Flathead County has budgeted $1,000,000 for this project and reserves the right to increase or decrease quantities to meet the budget. Crushed material to meet specifications below. Crushed material shall include 1/2" minus crushed bentonite with less than 16% moisture content and free swell greater than 16 cc to achieve Plasticity Index as required. Contractor shall determine the amount of bentonite to achieve gravel that meets the specifications. Not less than 60% of coarse aggregate particles by weight shall have at least two mechanically fractured faces (ASTM D5821). Contractor performs sieve analysis (AASHTO T27 and T11) and liquid limit (AASHTO T89 Method A & T87), and plasticity index (AASHTO T90) every 2,000 tons. The liquid limit for the material passing the No. 40 sieve is 25 maximum, and the plasticity index cannot exceed 0. Contractor performs sieve analysis (AASHTO T27 and T11) and liquid limit (AASHTO T89 Method A & T87), and plasticity index (AASHTO T90) every 2,000 tons. A stockpile of 3/4 inch natural fines is located immediately north of the asphalt plant. This material is to be utilized first by the contractor to produce the sanding material. It is unknown if more material to meet the project volume will be needed. These two materials are being bid as one project. Only one contract will be awarded for this work. Actual amounts to be crushed shall be determined based upon quantity and unit prices. Crushed material quantity will be paid for by determining a rodded unit weight (ASTM C29) for product(s) and accompanying owner survey(s) to determine pile volume. All material up to 4 feet shall be crushed; any material over 4 feet will be considered oversize. Material and pit area may be viewed by making an appointment with the Road Department. The exact location of material to crush and of the stockpile will be designated by the Flathead County Road Department at the time of crushing. Contact the Flathead County Road Department if there are any questions or to set up a time to view the crushing site. Bid proposals must be submitted on a form to be provided for the purpose, addressed to the Board of County Commissioners, Room 302, 800 South Main, Kalispell, MT 59901, and enclosed in an envelope marked, "Proposal for Crushing and Stockpiling Gravel." No proposal will be considered unless accompanied by a proposal security in the amount of ten percent (10%) of his bid to secure the bidder's express covenant that if the bidder is awarded the contract, the bidder will, within ten (10) days, enter into a formal contract for the purchase and sale of said materials. The successful bidder must contract to give preference to the employment of bona fide residents of Montana in the performance of the work. A resident bidder will be allowed a preference against the bid of any nonresident bidder from any state or county that enforces a preference for resident bidders equal to the preference given in the other state or county. The successful bidder will also be required to provide proof of Workers' Compensation insurance and/or an independent contractor certification from the State dated after May 1, 2005, as well as satisfy the County's minimum insurance requirements. No. 28303 REQUEST FOR QUALIFICATIONS The Flathead City-County Board of Health is requesting interested persons/firms to submit their qualifications for providing veterinary services to the Flathead County Animal Shelter. SCOPE OF WORK: The firm selected will provide veterinary services by a Doctor of Veterinary Medicine necessary to facilitate the Flathead County Animal Shelter's mission of spaying or neutering cats and dogs to reaching "adoptable" status, as well as other veterinary medical needs which regularly arise. The shelter normally houses up to 50 cats and 50 dogs, generally brought in as strays or owner surrenders. CRITERIA OF SELECTION: Selection of a person/firm for the provision of these services will be based upon the following criteria and each must be addressed within the qualifications response submitted in order to be eligible for consideration. 1. Demonstrated professional expertise and knowledge to create a healthy and safe environment for pets under the care of the Shelter focusing on the philosophies of herd health, preventative medicine, and maintaining good public health. 2. Demonstrated ability to provide basic or emergent medical care and surgical sterilization for pets in the Shelter to maximize the chances for a successful adoption of every pet. Services must be provided by a licensed Veterinarian and a veterinary technician. 3. These individuals/firms must provide proof of: a. Worker's compensation insurance, and b. $1M liability insurance (at minimum). The firm selected must be willing to name Flathead County as "additional insured." 4. Demonstrated ability to develop and administer clear medical and surgical policies and procedures for standardization of services to be implemented and consistently utilized. 5. Ensure that all adopted pets are as healthy at release as practical, respecting the financial parameters set by the Shelter. 6. Demonstrated ability to partner with the Shelter staff to cultivate a public image that adopted pets are healthy when they are released. Alternatively, for pets with real or potential health concerns at the time of release, be able to accurately describe in writing the issues of concern. 7. No. 28314 Legal Notice Comprehensive Five-Year Bond Review and Proposed Partial Bond Release for Troy Mine Inc. (Hard Rock Mining Operating Permit No. 00093) Located in Lincoln County, MT The Department of Environmental Quality (DEQ) has received a request for bond release from Troy Mine Inc. (TMI). TMI is authorized to operate an underground copper / silver mine and mill under Operating Permit No. 00093. The site is located on private and United States Forest Service lands in Sections 31 and 32 of Township 30 North Range 33 West, Sections 5, 6 and 7 of Township 29 North Range 33 West, Sections 12, 13, 14, 23, 24, 25, 26, 35 and 36 of Township 29 North, Range 34 West, and Sections 5 and 6 of Township 28 North, Range 33 West, approximately 10 to 15 miles south of the town of Troy in Lincoln County. DEQ currently holds a reclamation bond in the amount of $16,718,502. DEQ is proposing to release $1,508,219 and retain $15,210,283 after both releasing bond for completed reclamation tasks and increasing the bond as a result of a comprehensive bond review. The bond release was requested by the operator for the partial completion of reclamation, which includes demolition of the office/administration building, the secondary crusher building, the fine ore bin, the shop buildings, several other smaller buildings located at the mill and office sites, and the concrete foundations associated with each structure. Also, the mine's south portal has been backfilled and the surrounding area reclaimed. DEQ has determined the partial completion of reclamation would decrease the currently required bond by $2,468,918, resulting in a required bond of $14,249,584. In addition to the request for bond release, DEQ is conducting a comprehensive bond review for Operating Permit No. 00093. DEQ has determined that the current bonding level does not represent the present costs of compliance with the Metal Mine Reclamation Act, administrative rules adopted thereunder, and the operating permit. DEQ is proposing to increase the bond by $960,699. The bond increase is largely due to changes in fuel price, equipment rates, and updated indirect costs such as mobilization, contingency, and administration. DEQ has determined the net effect on the bond from the release request ($2,468,918) and increase as a result of the five-year comprehensive review ($960,699) is a bond release of $1,508,219. The procedure for adjusting bonds as a result of a comprehensive bond review is set forth in Section 82-4-338(3), MCA. Pursuant to Section 82-4-338(5), Montana Code Annotated (MCA), DEQ may not release or decrease a reclamation bond until the public has been provided an opportunity for a hearing and a hearing has been held if requested. The company and the public will have until Tuesday, March 8, 2022, to comment on these proposed changes to the bond amount. DEQ will issue a final bond determination after the comment period has expired. The company, or any person with an interest that may be adversely affected by DEQ's final bond determination, may obtain a contested case hearing before the Board of Environmental Review. A written request for a hearing must be filed with DEQ within 30 days of the issuance of the final bond determination, stating the reason for the request.
