No. 28604 Service Date: May 9, 2022 DEPARTMENT OF PUBLIC SERVICE REGULATION BEFORE THE PUBLIC SERVICE COMMISSION OF THE STATE OF MONTANA IN THE MATTER OF the Joint Petition for Approval of an Amendment to Agreement for Provision of Electric Service Facilities DOCKET NO. 2022.04.050 NOTICE OF PETITION AND OPPORTUNITY TO COMMENT On April 20, 2022, the Commission received a joint petition from NorthWestern Energy ("NorthWestern"), and Missoula Electric Cooperative ("MEC"), requesting Commission approval of an Amendment to an Agreement for Provision of Electric Service Facilities ("Petition"). The filing indicates that NorthWestern and MEC have entered into an agreement that modifies a previously Commission approved agreement under the Territory Integrity Act. The previous agreement had set the geographic boundaries of each party's exclusive electric service territory. Missoula County has approved a subdivision plat known as Heron's Landing, which is expected to be developed in multiple phases. Five such development phases fall within the exclusive territories of both NorthWestern and MEC. NorthWestern and MEC have mutually agreed in writing on which electric service provider shall be entitled to exclusively serve each of these phases. NorthWestern and MEC further agreed that all other service territories not impacted by the amendment shall remain as originally divided by the previous agreement and shall be the exclusive service territories of each party as set forth in the previous agreement.
