No. 29183 DEPARTMENT OF PUBLIC SERVICE REGULATION BEFORE THE PUBLIC SEDRVICE COMMISSION OF THE STATE OF MONTANA In re NorthWestern Energy and Hill County Electric Cooperative’s Joint Petition for Approval of an Agreement for Provision of Electric Service Facilities Docket 2023.01.012 January 30, 2023 Notice of Petition and Opportunity to Comment On January 5, 2023, NorthWestern Corporation d/b/a/ NorthWestern Energy (NorthWestern) and Hill County Electric Cooperative, Inc. (HCEC) filed with the Montana Public Service Commission (Commission) a Joint Petition for Approval of Agreement for Provision of Electric Service Facilities (Petition). The petition seeks the Commission’s approval of an April 28, 2017 agreement between parties that defines and sets exclusive service territories for NorthWestern and HCEC in Lots 1, 2, and 3 of the Hulett-tait 2nd Minor Subdivision, Hill County, Montana, Section 16, Township 32 North, Range 16 East, COS 604312 (Agreement). In the Agreement, NorthWestern and HCEC agree to a service area border line that splits portions of Lots 1-3. Under the Agreement, NorthWestern has the exclusive right to serve the portions of Lot 1-3 located west of the service area border line, while HCEC has the exclusive right to serve the portions of Lots 1-3 located east of the service area border line. NorthWestern’s distribution system includes an existing pole and service located approximately 662.4 feet west of the center of the service area border line, while HCEC’s distribution system includes an existing transformer located approximately 662.4 feet east of the center of the border line. A map showing the service area border line is attached to the Petition. A copy of the petition is publicly available at the Commission’s business office, 1701 Prospect Avenue, P.O. Box 202601, Helena, MT and online at the Commission’s website http://psc.mt.gov under Docket No. 2023.01.012.
