The Contractor must ensure that employees and applicants for employment are not discriminated against on the basis of their race, creed, color, age, religion, sex, physical or mental disabilities, or national origin and must show affirmative action to ensure Equal Employment Opportunities. Each bid or proposal must be accompanied by a Certified Check, Cashier’s Check, or Bid Bond payable to the SOMERS WATER & SEWER DISTRICT, in an amount not less than ten percent (10%) of the total amount of the bid. The successful bidder shall furnish an approved Performance Bond and a Labor and Materials Payment Bond, each in the amount of one hundred percent (100%) of the contract amount. Insurance, as required by specifications, shall be provided by the successful bidder and a certificate(s) of that insurance shall be provided and approved. This project may be funded in part or in whole with grant/loan funding. Award of the project will be contingent upon receiving funding and award concurrence from project funding agencies. The public may protest this license transfer in accordance with the law. Who can protest this transfer? Protests will be accepted from residents of the county of the proposed location Flathead County, residents of adjoining Montana counties, and residents of adjoining counties in another state if the criteria in 16-4-207(4)(d), Montana Code Annotated (MCA), are met. What information must be included? Protest letters must be legible and contain (1) the protestor’s full name, mailing address, and street address; (2) the license number 07-999-2344-002 and the applicant’s name BENTON PUB LLC; (3) an indication that the letter is intended as a protest; (4) a description of the grounds for protesting; and (5) the protestor’s signature. A letter with multiple signatures will be considered one protest letter. What are valid protest grounds? The protest may be based on the applicant’s qualifications listed in 16-4-401, MCA, or the grounds for denial of an application in 16-4-405, MCA. Examples of valid protest grounds include: (1) the applicant is unlikely to operate the establishment in compliance with the law; (2) the proposed location cannot be properly policed by local authorities; and (3) the welfare of the people in the vicinity of the proposed location will be adversely and seriously affected. How are protests submitted? Protests must be postmarked to the Department of Revenue, Office of Dispute Resolution, P.O. Box 5805, Helena, Montana 59604-5805 on or before March 13, 2023. What happens if the transfer is protested? Depending on the number of protests and the protest grounds, a public hearing will be held in Helena or Bigfork. All valid protestors will be notified of the hearing’s time, date and location. Hearings typically are scheduled within 90 days. A protester’s hearing testimony is limited to the grounds in the protester’s letter. Following the hearing, the Department of Revenue will notify the public whether the license transfer is approved or denied. How can additional information be obtained? No. 29199 DEPARTMENT OF PUBLIC SERVICE REGULATION BEFORE THE PUBLIC SERVICE COMMISSION OF THE STATE OF MONTANA In re the Petition of CED Wheatland LLC, CED Teton Wind, LLC and CED Pondera Wind, LLC Petition to Set Terms and Conditions for Qualifying Small Power Production Facility Pursuant to M.C.A § 69-3-603 Docket 2019.10.076 February 7, 2023 Notice of Public Hearing On May 10, 2022, the Montana Supreme Court issued its opinion in a consolidated appeal concerning a series of petitions to set terms and conditions for qualifying small power production facilities (“Petitions”), filed by CED Wheatland Wind LLC, CED Teton Wind, LLC, and CED Pondera Wind, LLC (collectively “CED”). The Montana Supreme Court remanded the matter to the Montana Public Service Commission (“Commission”) for further proceedings consistent with the Court’s opinion. On July 28, 2022, the Commission issued Procedural Order No. 7702d, which consolidated the Teton and Pondera dockets numbered 2019.09.066 and 2019.09.067 into this docket-the Wheatland docket, numbered 2019.10.076. The Procedural Order also established a variety of substantive and procedural deadlines for this docket. PLEASE TAKE NOTICE that the Commission will conduct a public hearing on CED’s Petitions. The public hearing will commence on February 27, 2023, at 9:00 AM, in the Bollinger Room located in the Commission’s offices at 1701 Prospect Avenue, Helena, Montana.
