NO. 29555 CITY OF KALISPELL NOTICE OF PROPOSED WATER RATE INCREASE A proposal to increase rates of the water utility and amend the water regulations to reflect the changes has been presented to Kalispell City Council. It is the intent of the City Council to consider the adjustment of the water utility rates to support inflationary costs for routine maintenance and operational services, planned capital improvement projects, and debt service coverage. A Public Hearing on the proposed rate increase and regulation amendments will be held Monday, July 17, 2023 in the Council Chambers of City Hall, 201 1st Avenue East, Kalispell, Montana, at 7:00 P.M. The increase in water rates and the amended water regulations will be effective August 17, 2023 (applied to the September 2023 billing cycle). No. 29580 Legal Notice Partial Bond Release and Comprehensive Five-Year Bond Review for Schellinger Construction Co., Inc. (Hard Rock Mining Operating Permit No. 00045) The Department of Environmental Quality (DEQ) has received a request for bond release for Schellinger Construction Co., Inc. (Schellinger). Schellinger is authorized to operate a construction aggregates quarry under Operating Permit No. 00045. The site is located on private land in Section 33 of Township 30N Range 16W, approximately 5 miles east of the town of West Glacier in Flathead County. DEQ currently holds a reclamation bond in the amount of $316,187. DEQ is proposing to release $77,388 and retain $238,799. The bond decrease is due to a revision of the approved reclamation plan. The reclamation plan was revised to require 10 cubic yards of topsoil/compost be blended into crusher fines as an organic amendment and spread as reclamation growth media. The reclamation plan originally required 65 cubic yards of topsoil/compost be used as an amendment for reclamation. DEQ determined Schellinger’s bond decreased after factoring in changes to fuel prices, equipment rates, updated indirect costs such as mobilization, contingency, and administration, and the reduction in the volume and transportation cost of organic amendment. Pursuant to 82-4-338(5), Montana Code Annotated (MCA), DEQ may not release or decrease a reclamation bond until the public has been provided an opportunity for a hearing and a hearing has been held if requested. MKH is authorized to operate three decorative rock product quarries under Operating Permit No. 00205. The sites are #53 Miller 9 Rock, #55 Miller Combest Rock, and #84 Rock 9. The #53 Miller 9 Rock and #84 Rock 9 sites are located on private land in Section 9 of Township 19N Range 26W. The #55 Miller Combest Rock site is located on private land in Section 9,10, and 15 of Township 19N Range 26W. All sites are approximately 3.5 miles southwest of Plains, in Sanders County. DEQ currently holds a reclamation bond in the amount of $7,356. DEQ is proposing to release $7,356 and retain $0. DEQ has verified through an onsite inspection the permitted sites have either been fully reclaimed or were never mined. Operating Permit No. 00205 will be permanently closed if the bond is released as proposed. No. 29583 NATIONAL FOREST TIMBER FOR SALE FLATHEAD NATIONAL FOREST The Yew Rock SBA Sale is located within Portions of Sections 16, 17, 20, 21, 27, 28, 29, 30, 31, 32, 33, and 34 T25N, R18W, Lake County, State of Montana, PMM. The Forest Service will receive Sealed and Oral bids at SO, Kalispell, MT before or at the time of public bid opening at 2:00 PM local time on 08/08/2023 followed by oral bidding for an estimated volume of 25174 ton of Western Larch & Other sawtimber, and 4275 ton of Lodgepole Pine sawtimber marked or otherwise designated for cutting. In addition, there is within the sale area an unestimated volume of Combined Softwood sawtimber, Other Softwood sawtimber, and Combined Softwood non-saw that the bidder may agree to remove at a fixed rate. This is a small business set-aside sale. If no self-certifying small business concern makes a valid bid, the Forest Service will readvertise this sale without restrictions on bidder size. Sale contains specified roads with an estimated public works construction cost of $304,981.34.
