No. 29410  NOTICE OF FINDING OF NO SIGNFICANT IMPACT AND   NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS   May 5, 2023   Montana Department of Commerce   301 South Park Avenue PO Box 200528 Helena, MT 59620-0528 406-841-2840  City of Great Falls  #2 Park Drive South Room 112  Great Falls, Montana 59403  406-771-1180 These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the Montana Department of Commerce and City of Great Falls.   REQUEST FOR RELEASE OF FUNDS   On or about May 21, 2023 the Montana Department of Commerce (Commerce) and the City of Great Falls (City) will submit a request to the US Department of Housing and Urban Development (HUD) for the release of HOME Investment Partnerships Program (HOME) funds under Title II of the Cranston-Gonzalez National Affordable Housing Act of 1990, as amended, HOME Investment Partnerships Program – American Rescue Plan Act (HOME-ARP) funds under Title II of the Cranston-Gonzalez National Affordable Housing Act of 1990, as amended  by Section 3205 of the American Rescue Plan Act of 2021, project-based voucher program funds under Section 8(o)(13) of the U.S. Housing Act of 1937, as amended and Neighborhood Stabilization Program (NSP) funds under Title I of the Housing and Community Development Act, as amended as amended by Title III of the Housing and Economic Recovery Act of 2008 to be used by Homeword, Inc. and NeighborWorks Great Falls, Inc. to undertake a project known as Baatz Block Apartments for the purpose of rehabilitating the historic Baatz Building located at 400 2nd Avenue South in Great Falls.  Plans call for the replacement of non-historic vinyl windows with windows that are historically accurate, replace glazing in original historical windows with new double glazing while preserving/repairing the original windows, re-point/repair existing masonry as needed, restore the original upper floor skylight, install new roofing maintaining the original configuration of the historic roof, restore the original storefront and entryway, replace the entire water and wastewater plumbing system, full replacement of the electrical and HVAC systems, and add energy efficiency upgrades at the inside of the exterior building envelope.  An elevator serving the basement through the third floor will be added.  Primary circulation spaces at the second and third floors will be preserved, including the open stairs connecting the second and third floors.  The third floor will offer studio, one- and two-bedroom apartments, with one apartment that could be occupied by on-site staff if needed. The second floor will have studio, one- and two-bedroom apartments. The ground floor will have caseworker and service provider offices, a community room/kitchen, staff room, classroom, laundry facilities, building maintenance room, property management office, main reception and residential lobby. Commerce anticipates allocating $300,000 in Commerce HOME funds, and the City anticipates allocating approximately $750,000 in City HOME funds, $250,000 in City HOME-ARP funds, and $314,000 in City NSP proceeds to develop 25 units of permanent supportive housing for individuals and families experiencing homelessness. The total estimated cost of the project is $11,469,247.   FINDING OF NO SIGNIFICANT IMPACT   Commerce and the City have determined that the project will have no significant impact on the human environment.  Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required.  Additional project information is contained in the Environmental Review Record (ERR) on file at Montana Housing 301 South Park Avenue Helena, Montana, at Homeword, Inc. 1535 Liberty Lane Suite 116A Missoula, Montana, at NeighborWorks Great Falls 509 1st Avenue South Great Falls, Montana, and at the City of Great Falls Civic Center #2 Park Drive South Room 112 Great Falls, Montana. The ERR may be examined or copied weekdays 8:00 A.M to 5:00 P.M at the Montana Housing office and the City of Great Falls office, from 8:30 A.M. to 5:00 P.M. at the Homeword office, or Monday through Thursday from 8:00 A.M. to 5:00 P.M. at NeighborWorks Great Falls office.   PUBLIC COMMENTS  Any individual, group, or agency may submit written comments on the ERR to the Montana Department of Commerce or the City of Great Falls.  All comments received by May 21, 2023 will be considered by Commerce and the City prior to authorizing submission of a request for release of funds.  Comments should specify which Notice they are addressing.  ENVIRONMENTAL CERTIFICATION  Commerce certifies to HUD that Scott Osterman in his capacity as Director of the Montana Department of Commerce and the City certifies to HUD that Tom Micuda in his capacity as the Director of Community Planning and Development of the City of Great Falls consent to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied.  HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows Montana Department of Commerce and the City of Great Falls to use Program funds.  OBJECTIONS TO RELEASE OF FUNDS  The US Department of Housing and Urban Development will accept objections to its release of funds and Commerce’s and the City’s certifications for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Commerce or City Certifying Officers; (b) Commerce or the City have omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.  Objections regarding HOME, HOME-ARP, and NSP funds must be prepared and submitted via email in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to Noemi Ghirghi, CPD Region VIII Director, at CPD_COVID-19OEE-DEN@hud.gov. Objections regarding public-based voucher program funds must be prepared and submitted via email in accordance with the required procedures and shall be addressed to the HUD Region VIII, Office of Public Housing at DenverOPH@hud.gov.
