NO. 30245 WATER COURT NOTICE The Montana Water Court plans to issue preliminary decrees for all existing water rights in the hydrologic basins known as Basin 76L (the Flathead River and its tributaries below Flathead Lake), and Basin 76LJ (Flathead Lake and the Flathead River and its tributaries above Flathead Lake). Existing water rights have priority dates earlier than July 1, 1973. On March 29, 2024, the United States of America filed motions to extend stays currently in place through at least January 2025 for issuance of the preliminary decrees. The State of Montana and the Confederated Salish and Kootenai Tribes join these motions. If the stays are extended, the Court will not issue the preliminary decrees until the stays expire. Before ruling on the motions, the Court provides any interested person the opportunity to respond to the motions. The motions and the Court’s order may be found on the “Notices and Information” page on the Montana Water Court website: https://courts.mt.gov/courts/water/Notices-Info/PublicNotices (scroll to bottom). Any response or objection to the motions must be filed with the Water Court not later than May 3, 2024.
