A letter with multiple signatures will be considered one protest letter. What are valid protest grounds? The protest may be based on the applicant’s qualifications listed in 16-4-401, MCA, or the grounds for denial of an application in 16-4-405, MCA. Examples of valid protest grounds include: (1) the applicant is unlikely to operate the establishment in compliance with the law; (2) the proposed location cannot be properly policed by local authorities; and (3) the welfare of the people in the vicinity of the proposed location will be adversely and seriously affected. How are protests submitted? Protests must be postmarked to the Department of Revenue, Office of Dispute Resolution, P.O. Box 5805, Helena, Montana 59604-5805 on or before September 28, 2024. What happens if the transfer is protested? Depending on the number of protests and the protest grounds, a public hearing will be held in Helena or Bigfork. All valid protestors will be notified of the hearing’s time, date and location. Hearings typically are scheduled within 90 days. A protester’s hearing testimony is limited to the grounds in the protester’s letter. NO. 30657 Legal Notice Proposed Partial Bond Release for Montana Rockworks, LLP (Hard Rock Mining Operating Permit No. 00175) The Montana Department of Environmental Quality (DEQ) has received a request for bond release for Montana Rockworks, LLP (Montana Rockworks). Montana Rockworks is authorized to operate two hard rock mines for rock products under Operating Permit No. 00175. The Moose Mountain site is located on private lands in Section 30 of Township 26 North Range 25 West, approximately 13 miles southwest of the town of Marion in Flathead County. The McGregor Lake site is located on private lands in Section 32 of Township 27 North Range 25 West, approximately 9 miles west southwest of the town of Marion in Flathead County. DEQ is conducting a comprehensive bond review for Operating Permit No. 00175. DEQ has determined the current bonding level does not represent the present costs of compliance with the Metal Mine Reclamation Act, administrative rules thereunder, and the operating permit. DEQ is proposing to increase the bond by $52,737. The bond increase is largely due to changes in fuel prices, equipment rates, removal of nonmobile site equipment and updated costs such as mobilization, contingency, and administration. In addition to the comprehensive bond review, DEQ received a bond release request from Montana Rockworks in the form of a permit revision request to better align the amount of bond held with the amount if disturbance generated by Montana Rockworks’ operation. DEQ has determined the reduction in maximum allowable disturbed acres would decrease the currently required bond by $84,657, resulting in a required bond of $303,864. DEQ has determined the net effect on the bond from the five-year comprehensive review (+52,737) and decrease as a result of the release request (-$84,657) is a bond release of $31,920. Pursuant to Section 82-4-338(5), Montana Code Annotated (MCA), DEQ may not release or decrease a reclamation bond until the public has been provided an opportunity for a hearing and a hearing has been held if requested.
