NO. 30864 Legal Notice Partial Bond Release and Comprehensive Five-Year Bond Review for Atlantic Richfield Company (Hard Rock Mining Operating Permit No. 00012) The Montana Department of Environmental Quality (DEQ) has received a request for bond release from Atlantic Richfield Company (ARCO). ARCO’s facility and associated disturbances are located on private property approximately 6 miles northwest of Anaconda, Montana off MT Highway 1 in Section 23, Township 5 North, Range 12 W in Deer Lodge County. DEQ currently holds a reclamation bond in the amount of $184,373. DEQ is proposing to release $149,673 and retain $34,700. The bond decrease is a result of calculating the bond amount based on a determination of mining disturbances which occurred prior to July 1, 1974. Mining disturbances that occurred prior to July 1, 1974, are subject to a statutory required bond amount of no more than $500 per acre. All 99 acres of mining disturbance at this site existed prior to July 1, 1974. In addition to the request for bond release, DEQ conducted a comprehensive bond review for Operating Permit No. 00012. DEQ has determined that the current bonding levels do not comply with the Metal Mine Reclamation Act, administrative rules adopted thereunder, and the operating permit. DEQ is proposing to decrease the bond by $149,673. The bond decrease is due to statutory limits on mining disturbance which occurred prior to July 1, 1974. DEQ has determined the release request and the five-year comprehensive review will result in a bond release of $149,673. The procedure for adjusting bonds as a result of a comprehensive bond review is set forth in Section 82-4-338(3), MCA. Pursuant to Section 82-4-338(5), Montana Code Annotated (MCA), DEQ may not release or decrease a reclamation bond until the public has been provided an opportunity for a hearing and a hearing has been held if requested. The Permittee and the public will have until January 24, 2025, to comment on these proposed changes to the bond amount. DEQ will issue a final bond determination after the comment period has expired. The Permittee, or any person with an interest that may be adversely affected by DEQ’s final bond determination, may obtain a contested case hearing before the Board of Environmental Review. LBC’s facility and associated disturbances are located on private property about 3.6 miles northwest of Drummond, MT in Section 14, 15, and 23, Township11 North, Range 13 West, in Deer Lodge County.   DEQ currently holds a reclamation bond in the amount of $60,715. DEQ is proposing to release $27,117 and retain $33,598. The bond decrease is a result of calculating the bond amount based on a determination of mining disturbances which occurred prior to July 1, 1974. Mining disturbances that occurred prior to July 1, 1974, are subject to a statutory required bond amount of no more than $500 per acre, and 5.7 acres of mining disturbance at this site existed prior to July 1, 1974. The access road leading to the mine and the landing area at the mine will be incorporated into the industrial site adjacent to the permit area after final mine closure.   In addition to the request for bond release, DEQ conducted a comprehensive bond review for Operating Permit No. 00022. DEQ has determined that the current bonding levels do not comply with the Metal Mine Reclamation Act, administrative rules adopted thereunder, and the operating permit. DEQ is proposing to decrease the bond by $27,117. The bond decrease is due to statutory limits on mining disturbance which occurred prior to July 1, 1974, and identifying post mine land use for the landing area and road to the mine.    DEQ has determined the release request, and the five-year comprehensive review a bond release of $27,117.   The procedure for adjusting bonds as a result of a comprehensive bond review is set forth in Section 82-4-338(3), MCA.
