NO. 30013 NOTICE OF HEARING PETITION TO RECOGNIZE COUNTY ROAD FLATHEAD COUNTY, MONTANA Farm Road is a declared County Road / Right-of-Way (hereinafter “ROW”) located in Flathead County, Montana. Farm Road is maintained by Flathead County and used by the public as required under § 7-14-2622(1), MCA. A portion of Farm Road does not conform with the declared ROW as described in County Records. The County desires to have this Court recognize the ROW as it lies (“Proposed ROW”). Tract ID 2720X07-SKA-1 (hereinafter “Lot 1”) and Tract ID 2720X07-SKA-2 (hereinafter “Lot 2”) are Lots 1 and 2 (respectively) in the Sky Ranch Addition Subdivision (Document Number 200135210450 in the records of Flathead County, Montana). The Proposed ROW lies over Lot 1 and Lot 2, west of the originally declared ROW. A map and legal description of the Proposed ROW is below. Although the Proposed ROW is inconsistent with the dedication, it is consistent with the location of Farm Road as built and the neighboring plats and property boundaries contained in the Sky Ranch Addition. 11. The Proposed ROW has been traveled and used for more than 10 years pursuant to §7-14-2622(1)(c), MCA. Flathead County desires the Proposed ROW to be recognized by this Court as the legal route and County ROW. Flathead County has requested that the Montana Eleventh Judicial District Court hold a public hearing regarding the declaration of the Undeclared ROW to be designated as County ROW. A public hearing has been scheduled in the Flathead County Eleventh District Judicial Court, Cause No.: DV-2023-1449B, before the Honorable Robert B.
