On July 1, 2024, NorthWestern Energy (“NorthWestern”) filed a Petition for the Commission to Substitute an Alternative Methodology for its FERC 302 Filings and Motion for Waiver (“Petition”) with the Montana Public Service Commission (“Commission”). The Petition concerns estimates of avoided costs NorthWestern is required to file every two years under Montana and federal regulations implementing the Public Utility Regulatory Policy Act of 1978.  2. In the Petition, NorthWestern asks the Commission to indefinitely waive Mont. Admin. R. 38.5.1908(2), which requires NorthWestern to file avoided cost data by July 1 of even-numbered years. Instead of submitting the avoided cost data, for the avoided energy costs, NorthWestern proposes to provide links to the California Independent System Operator website containing the present and historical 15-minute locational marginal price rates within NorthWestern’s Balancing Authority Area. For avoided capacity costs, NorthWestern proposes to submit estimates based on the peaker methodology, using the least-cost capacity resource identified in NorthWestern’s latest integrated resource plan. Through its Motion, NorthWestern requests that the Commission waive the filing requirements contained in Mont. Admin. R. 38.5.1908(2), for this year, which, under Mont. Admin. R. 38.5.1908(2), were due as of July 1, 2024.  3.
