Kalispell man serving suspended sentence for rape again accused of sexual assault

A convicted rapist given a suspended sentence in Flathead County District Court in 2023 is now facing the same charge in Lake County.  

Fabian Alexander Perez-Calderon, 25, pleaded not guilty Nov. 13 to one count of felony sexual intercourse without consent in the 20th Judicial District Court, which covers Lake and Sanders counties. He remains in the Lake County Jail with bail set at $50,000. 

Prosecutors accused Perez-Calderon of raping a woman he met through Facebook. The victim, who came forward to the authorities in March 2024, told investigators the two agreed to meet offline, according to court documents. Perez-Calderon allegedly agreed to bring alcohol. 

When they got together, Perez-Calderon aggressively attempted to kiss the victim, court documents said. She asked him to leave, a request she believed he had complied with.  

While in bed a little later, the victim looked up to find Perez-Calderon allegedly standing naked in her room. He grabbed her hair, prompting her to cry and tell him he was hurting her, court documents said.  

"Don't you find me attractive?" he allegedly asked her before pulling off her shorts. Perez-Calderon put his hand over her throat and hair before raping her, court documents said.  

Perez-Calderon remains on probation for a rape conviction in Flathead County District Court. In March 2023, Judge Robert Allison gave Perez-Calderon a 10-year suspended sentence for allegedly raping a woman in a car following a bonfire party in 2022. He was also designated a level one sex offender and ordered to undergo sex offender treatment. 

Allison simultaneously gave Perez-Calderon a suspended five-year sentence in an unrelated case dating back to 2021. In that case, Perez-Calderon was accused of punching and beating a man with a skateboard. Allison ordered him to pay $4,149.52 in restitution to the victim.
